RFE on AOS

Hey VJers,

We just recieved a email for RFE yesterday evening, I am so anxious. We filed our AOS in December along with our EAD and AP, we really thought we would get the EAD and AP before the AOS was even done, the RFE is on our AOS. We are waiting on the hard copy to see what we could have possibly missed. We have been lucky to have everything go so smooth until now, could really use some advice on shouldn't we have gotten the EAD and AP apporoved before this or is it normal to go over the AOS first. It's normal. Usually most RFEs are taken care of before the EAD and AP can be approved. The most common error I see is with the I-864.

Edit: EAD and AP usually take around 70-90 days. I'd wait until March before I got expected it. I see a lot of people telling others it takes a month or two and that only leads to disappointment because it's not true.

Thank you, It is a bit of a disappointment when you see so many moving so fast with no complications, yes we are thinking it has to be the I-864, will probably have to get a co sponser, was hoping i could pull it off on my own, but looking like not gonna happen. the whole process though has been frustrating, answering the same things over and over..ughhh Will they say exactly what is wrong in the RFE hard copy or will that be a guessing game also?

Harpa is correct. Remember also that your EAD relates to your AOS. If there is something needed for AOS, they put a hold on the entire case until it is submitted. You are allowed to do biometrics but they will not issue an EAD until all required documents are in. I got an RFE email last week (my son is adjusting his status). I also received the biometrics letter. With school off next week, I'll be taking him for an early walk in. The RFE hard copy should get to me by this weekend to early next week. When you get yours, express whatever they request, if you can, so that the process can be resumed andyour card ordered. That's my intention. All the best.

They will say what is wrong, though they can't always say how to fix it if there are multiple ways of doing so. Did you include proof of current employment?

Yes proof of employment and tax transcripts, and all assets. Will have to wait and see, and yes already have co sponser lined up and filing out paperwork as of this morning for just in case that is it, and will hopefully get letter by Monday and info mailed back by Tuesday. We were very thorough with our packet, it took us a 2 weeks to finally send it, because we went over it and over it.

Yeah, an RFE sucks. I filed mine at the end of September and got an RFE at the end of December. Took me 128 days to get my EAD and I'm still waiting on my greencard.
