pending i-130 would like b2

Hi e. me and my wife sent in her packet in November . but i i have leave coming up in April. we were woundering if its possible to get a visit visa for a couple weeks.... i just signed a beware contract here in Kuwait for at minimum one more year. she has residency here under my visa. her father work here in Kuwait also. we have complete intentions to come back as i have to work. she does not work. do you think the embassy here in Kuwait will approve the visit visA?

We were in kuwait also and i can tell that chances are not good for that visit visa but some people do get them there, but the embassy is very very picky.

Sorry.... the packet was for the i-130 for her cr-1 visa. Shes from the Philippines living here in Kuwait where we got married.. On a family visa under my visa.

The tourist visa will be denied. A pinay married to a USC with a 130 in process has zero chance for many reasons. The main one would be her inability to comply with the strongest ties rule. Those ties are to her husband upon entry into the USA. Even if she was granted a visa she would be denied entry at the POE.

I like to think we both have pretty good ties to prove we will come back to Kuwait. My wife has a cellphone contract that is not up until august. Our lease agreement is in both our names. i just signed the new ine year contract with my company. She is under the dependant visa on my residency. her dad is working here in Kuwait. we still have paperwork pending in Kuwait for her cr-1 visa police certain,nbi , etc...

If the embassy here in Kuwait does give the visa what are the chances she will be stopped at poe ...probably Houston.? And for what reasons?

wow....a cellphone contract...now that's a strong tie to a specific country.

The main problem is this: a huge percentage of foreign spouses who enter the country on tourist visas have a sudden change of mind about their alleged intentions (usually occurring right after clearing customs) and decide to stay put pending all the paperwork, etc while the US spouses promptly begins his or her new (but undisclosed at the time of the visa interview) job in the US....most VOs know this, most CPB officials know this....it is hard to believe that waving a cell phone contract around will overcome 214b....but hey, for $140, test your luck.

I now doubt that anything said here by anyone will persuade you that this wont work. What sounds good to you simply means zero to the embassy. The only way you will ever know & be satisfied is to send her in to the fray. She will step up to the window & the moment of truth.

Your situation has nothing to do with her tourist visa application nor does her dads.

The chances of her being stopped for questioning at the POE are 100%. If she has a pending 130 she could easily be denied entry. The reason would be her ties are to her USC husband. If they felt she was attempting visa fraud in this attempted entry it could turn very serious very quickly.

I saw a report of a married filipina getting a tourist visa for a visit with a I-130 pending (granted, it was only valid for a few weeks). It can happen. We can't tell you what will happen - you have to apply and see.
