My wife and I are interested in your service because we have a J-2 and J-1 Visa respectively with the 2 year rule. My wife is taking a Master that will be finished spring next year. I was admitted to a Ph.D program that it is going to last for 4-5 years. We know that a J-2 Visa enables me to study but I would like to change my status to F-1 Visa. Our problem is that my wife must have to return to our country in 1 year but we do not want to be separated and particularly now that we are having a baby. Therefore, we want to know if you can give us an advice about this case and how much it is going to cost. If you can't, please let us know if you know someone that can help us.

Thank you very much.

CASIORENBAR,

VisaJourney is a forum dedicated to family based visas and it's free of charge since it is used mostly for information purposes.

Since neither one of you is here on a family based visa, you will need to go a different route. Have you asked your school to see if they can guide you on how to change your visa status to an F1? They may be able to help in filing the correct form which I believe it's form I-539 along with form I-20 from the school. Now, I don't know if you can add your wife to this status change, so that should also be asked.

If they're not able to help, which they should, then I would suggest you contact an immigration lawyer for advice.

Diana

Gather is couple if from Colombia and studying in the US. Step niece is from Bogota and came up here to work on her Ph.D. As long as her family was paying for tuition at out of country rates, they rolled out the red carpet for her in terms of visa's.

In the same respect, have relatives down there that are renting, and can't even get a tourist visa for a short visit up here. Which is one reason why I feel our Statue of Liberty poem should be changed to bring us your rich and wealthy.

Finalizing our information for the interview tomorrow morning, and I'm a little skeptical about the Police Certificate. My fiancee went to the site and entered her information, and just got a page with a lot of text including (in bold capital letters), "NO TIENE ASUNTOS PENDIENTES CON LAS AUTORIDADES JUDICIALES". Is printing this page sufficient, or am I missing something? It seems to be far from an official document which has me nervous.

Met this woman, fell in love, and wanted to bring her here. Looking over these immigrations forms with a full time engineering job was too much for me, so found one of the top US immigration attorneys for guidance. Recall calling her telling she required a police report that she has no police record. Kind of stumped her to, getting a report saying she didn't do anything wrong and doesn't have a criminal record.

That phase in English means something like this. "DOES NOT HAVE ANY RECORD BEFORE JUDICIAL AUTHORITIES".

Understand this phase is quite common.

While my wife refers to me as her English teacher, she only requested I learn two words in Spanish. "Sí querida", whatever this means, LOL.

So the visa was approved at the interview on 3/26, but still no sign of a waybill number. She has called the embassy to ask without success and nothing is updated online. Any tips or further information we might be missing? She is in Bogota, so everything I've seen posted here is that it would be 4-5 business day.

It should really only take about 2-3 business days if being delivered within Bogotá. However, this is Colombia we're talking about and they had 2 holidays last week so I'm thinking they're trying to catch up. Also, I've heard of people who have had to go to DHL in person and their visa envelope was sitting there all along even though there was no waybill number issued.

She has tried calling DHL and been told she can't do anything without a waybill number. I suppose she can go to the actual location and try.

We got our interview date!! It just happened to be the one day that I have a very important day at work that will be difficult/impossible to change. I already emailed the embassy asking them to reschedule. Will this be a problem? How long after might they reschedule it for? Anyone have experience with this?

Only the beneficiary needs to take his/her birth certificate to the interview in Bogotá. You, the beneficiary, will need to go to your notary and ask for a certified copy of your birth certificate with marginal notes which will say whether you have been married before and/or divorced. If you haven't been married before it will either say "sin notas marginales" or not say anything at all.

Your fiancée, the petitioner, won't need to get another birth certificate since it was already sent to the USCIS with the initial I-129F.
