Hey all,

My ex-wife and I were married for awhile, we moved to the US, she recieved the conditional greencard. Things didnt work out, and we divorced. She filed for removal of conditions. I wrote a letter with her app stating that in my opinion it wasnt fraudulent, etc.

Long story short, yesterday she recieved a letter for an interview for the removal of conditoins... except she forwarded it to me and it says that I must be present. I live in PA, she lives in SC and I'm going on active duty military orders very soon.

I called DHS and they were about as helfpul as hitting myself in the head with a hammer. In the end the rep just said for her to show up without me.

Any advice? The marriage was bona fide and didnt work out. I have no problem being interviewed, i just cant make it 14 hours away for it.

Give her an affadavit stating same with a copy of your orders as your reason for not being there to attend. I don't understand why you would have to be there anyway if she filed on her own because of the divorce. Hope that helps ... :star:

if she filed the ROC paperwork properly, your name would not be on that letter that you have.

Sorry.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Called the military line and got somewhat better customer service.

During her filing our divorce was pending so she checked that she was married but noted the divorce was pending in the comment box and I attached a letter stating why we divorced, etc.

After some calling through the military line, they told me to advise her to just show up without me, all the divorce paperwork, evidence, etc and advise the interviewer of the change in status.

That's the easier path, and really the one 'to do'.

@Darnell,

Thanks. It was an amicable divorce and I really want to help her. On the same note, I'm pretty frustrated that I'm the one calling and doing all the leg work, which is a completely separate issue.

I forwarded their advice on. If they want to interview me, I'll be more than happy to, just not 14 hours away.
