We've been together for 10 yrs and married for almost 5 years.Plus we have a kid. I cant believe how spiteful he could be at times.He threatens to not allow me to get the Green Card.We sent the I 130 which I learned was a mistake to send as a stand alone.Anyhow,I could wait since I did it the long way..What bothers me is the constant threats.ahe also needs to gather his tax information and still hasnt.My Joint Sponsor will have my documents ready by next week and after that,I just need to do my Medical.My husband is causing alot of stress.Do I have any rights as his wife for half a decade and the mother of his child ?? i mean,just incase he does something ?

I'm really not sure, it is a lot less complicated if you are already in the US but it sounds like you're not there at the moment. It is unfortunate your husband is not being supportive at this time, my best piece of advice is to see if you can hold on till the paperwork pulls through before you make any drastic decisions, I do think it would be hard to process the application without his support even though you have been married a while. I am very sorry for what you are going through though and hope things get better. If things are that terrible and you need options, I think you should try and get legal advice, there are lawyers who will charge 30 dollars to answer an immigration question, if you are able to do something like that, I would recommend it so that you have your options if things don't work out.

Again, I'm sorry, I hope for the sake of you and your child things go well.

Urm....I would imagine the answer to your question is quite straight forward.

Leave him.

No one should put up with that. Pack your stuff, and head back to Canada, and get on with enjoying your life and not living in misery for the rest of it.

AOS Journey

Day 0 - 07/10/2012 - AOS package (I-130,I-485, I-175) mailed to Chicago with FedEx.

Day 1 - 07/11/2012 - Confirmation from FedEx that package arrived and was signed for.

Day 3 - 07/13/2012 - Text confirmation from USCIS of receipt.

Day 4 - 07/14/2012 - Online banking shows that cheques were cashed.

Day 9 - 07/19/2012 - Received 3 out of 3 NOA letters in the post.

Day 11 - 07/21/2012 - Received biometrics appointment letter, appointed set for 08/07/2012.

Day 16 - 07/26/2012 - Completed biometrics walk in.

Day 56 - 09/04/2012 - Received text notification to state that my EAD has been ordered into production.

Day 59 - 09/07/2012 - Received 2nd text notification to state that my EAD has been ordered into production.

Day 62 - 09/10/2012 - Text notification that EAD has been mailed.

Day 64 - 09/12/2012 - EAD received in the mail.

I'm really not sure, it is a lot less complicated if you are already in the US but it sounds like you're not there at the moment. It is unfortunate your husband is not being supportive at this time, my best piece of advice is to see if you can hold on till the paperwork pulls through before you make any drastic decisions, I do think it would be hard to process the application without his support even though you have been married a while. I am very sorry for what you are going through though and hope things get better. If things are that terrible and you need options, I think you should try and get legal advice, there are lawyers who will charge 30 dollars to answer an immigration question, if you are able to do something like that, I would recommend it so that you have your options if things don't work out.

Ask A Lawyer.Com for $30 bucks is not a Answer. (For one question) Pay $100.00 to talk to a real in person Immigration Attorney for a half hour to 45 minutes. :thumbs:

As far as immigration, NO you have no rights, your child might have rights to his USC. You have rights in your country to try to get support for the child. But there is NO LAW on the books, that says a husband must migrate his wife to the US.

Usually the fact that you can't get a passport for a USC child / remove them from the country without both parents permission gets the immigrants attention. :bonk:

The child has two parents.

The threat of Child Support always gets a mans attention. :bonk:

Thats for you to decide what is best for yourself and child.

Deep down inside a human, it is mean. When they know your weak point they will take advantage of it. If you think about your future, you can yield to him until everything is done. If you think dignity is more important, then good bye this mean husband. Pitiful, there is no solution for you because there is no law to tie him with sponsoring your AOS. Good luck.

The child has two parents.

If a court awards joint custody, getting a passport will be in the court order. That aside though, its dangerous for either parent to try to use child support and custody arrangement as bargaining chips.
