I read that they need to send their w-2 ,1099 and internal Revenue income tax return ( not the state income tax..? whats the difference?)What are those ? What else do they need to send ?

For the I-864 AOS package, the information needed inside is as follows:

~bar-coded cover sheet from the payment portal (this must be the first page in the package)

Petitioner's documents:

~I-864 filled out, signed, and dated

~tax information*

~pay stub(s) and/or employment letter (optional, but good proof of current income)

Joint sponsor's documents:

~I-864 filled out, signed, and dated

~tax information*

~pay stub(s) and/or employment letter (again, optional, but good proof of current income)

~proof of US citizenship/residency (copy of: US birth certificate, bio-data page of US passport, US naturalization certificate, front/back of green card, etc)

*Tax information: You either submit the most recent year (2010 or 2011) OR the last three years (2007, 2008, 2009 or 2008, 2009, 2010). And then you have an option of either sending in a tax transcript (much preferred by NVC and most embassies/consulates) OR tax returns (1040s) and W2s and any other schedules if applicable.

If you're confused about tax form numbers, then refer to the US spouse, they should know what these are. But again, tax transcripts (ordered from the IRS for free) are much preferred and much easier to understand.

W2 and 1099 have three separate papers, one to file with the IRS, one to file with your state and one to keep for personal tax records. They all have the same information on them.

W2 is for wage earned employes

1099 are for independent contractors and self-employed

Schedules are the different worksheets that go with your tax return. (ie schedule C is for gains and loss of self employment)

The consulate only wants the Federal Returns that were sent to the IRS. They don't care if you filed with the state (some states don't even have income tax)

They either want the 1040's with the W2s or 1099s and all the schedules, or the preferred tax transcripts. Transcripts can be ordered for free online at the IRS web site. Mine came in the mail with in four or five days.
