Hi all

Thanks for taking the time to help me!

My fiancé is currently on a visitors visa and is here in America with me for at least a couple more months. We are in Process of K-1 visa. Filed in October so we are still waiting for NOA 2. Does he have to return to his country for the interview? Is there anyway to just complete this in America instead of having his return to his country and go to the American Embassy there? It just seems pointless to leave America and go to an American embassy.

Yes he must return for the interview in his country. There is no place IN the United States to interview for and be issued a K-1.

In order to get married and adjust status (get a green card) based on a K-1 he must ENTER the USA using a K-1 visa. he currently did not enter with a K-1.

Be very careful that he does not have an overstay, if his current authorization to visit expires he must return to his country.

He definitely will not overstay! I just think it is sort of strange to travel to another country to go to an American embassy. But if thats what needs to be done then that is what we will do.

No, there is no way to complete this in America. He must interview at the US Embassy in his country.

It isn't pointless.

For example; It takes 6 months to go through the K-1 process. Two fiancees are petition for by their respect US citizen love ones. Fiancee 1 has a visitor visa and hop on the first plane to the US to complete the K-1 process in the US. Fiancee 1 is immediately with her love one. Fiancee 2 can not get a visitor visa. Fiancee is stuck waiting for six months. Doesn't seem fair right that Couple 1 are immediately reunited while Couple 2 have to wait apart for six months. Needing to interview at the US Embassy in their countries puts both couple in the same position. However, Couple 1 have the benefit that Fiancee 1 can visit the US. Couple 2 don't get that benefit.

well, not ALL FOREIGN FIANCES are able to be in USA during the process.. hence the reason for VISA to all them INTO the USA..

07/24/15 I-751 Mailed to Cali. Service Center
09/03/15 Biometeric scheduled and completed

01/26/16 ROC Letter arrived
