Dear VJ members,

My husband (US citizen) and I (overstay of tourist visa) are in the process of AOS based on an immediate relative (spouse). We would like to file our taxes jointly since we are married and have been before Dec. 31st 2011. Since I am awaiting my SS# and based on the processing time, it looks like I won't have it until after the tax filing date (April 17th), we thought about filing for an extension. Here is the question: How we are supposed to file for taxes/file an extension if both of those forms require both of the spouse's SS# and I will not have mine until after the filing date. It looks like we will not be able to even file for an extension since even the extension requires both of ours SS#. Is this information correct? Any help would be greatly appreciated! ** I was advised not to file for ITIN since I am in the process of getting a SS#**

I believe you could write "applied for" in the space for your SS number on the extension.

Seems odd that it would take that long to get your SS number

Once you are eligible for a SSN you apply and you will get it in about one week. You are currently not eligible. One you get your EAD you will be eligible for a SSN.

ITINs are given when the person cannot get a SSN. You cannot currently get a SSN.

2/06/13: APPROVED!
