Dear All,

does someone have an experience with expediting of AOS due to military obligations?

I just received my fiancee visa and I'm going the U.S. to marry my fiancee in couple of weeks. My soon-to-be-husband is in the military and he got orders for Europe (after the visa has been approved) and will be leaving approx. 3 months after our marriage. I'm from Europe and I'll go with him, of course. But we don't know how to handle the situation with AOS after getting married. Should I apply for AOS - can we make it within 3 months? I don't want to stay in the U.S. without him but I also don't want to stop the whole process after getting married, I'll need the green card in the future and don't want to go through similar process again (applying for spouse visa) when we already invested time/money into fiancee visa.

We heard that the AOS process can be expedited by military but how can we do it? My fiancee contacted JAG and also the military help desk (three times already) but they didn't know how to help us...weird.

Has anyone experience with expedition due to military obligations and how long did it take?

Yes we put AOS with military expedite.

You file AOS right after you married - same way as everyone else does. http://www.visajourney.com/content/k1k3aos

But the difference is - frontload frontload frontload. - get all kinds of evidence, military spouse ID, military health enrollment, military spousal benefits from life insurance etc, include all that. Plus the most important part - deployment papers with a letter from command stating when hes going and how long for.

On the package put " expedite - military " Have an expedite letter request in the package with the deployment papers and letter from command.

The other way is -

Get everything together with frontload mail it off then, When you know that the package was received by the service center - call the military help line and request expedite, they would then ask you to send the proof and you would then send the deployment papers, command letter etc.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Thank you a lot for your advice!! I'm really happy to see that it can be done within two months..:) By any chance, do have any experience with re-entry permit? I should probably file for it as soon as I get the green card. Or could I file for it togehter with AOS?

Never needed a re-entry permit sorry cant help with that one but yes ours was done in 2 months 8 days with no interview. That includes me getting the green card in the mail.

you'll be processed within 3 months! it took me 67 days to get approved for mine and I'll be receiving my greencard this week. I had no letter included for faster handling or anything else since my husband is stationed stateside, but we still got everything done very fast & easy.

about the re-entry permit. file with the AOs package, because the fee will be waived then.

A re-entry permit is not the same as AP the OP is looking at getting a re-entry permit because the AP card is no longer valid once she gets the green card.

The re-entry permit lets you leave and return to the US when staying outside the US longer than 1 year.

A re-entry permit is not the same as AP the OP is looking at getting a re-entry permit because the AP card is no longer valid once she gets the green card.

I saw that. that's why I said re-entry permit above and not advance parole!

Thanks for your advice! Is it really possible to file for reentry permit together with AOS? I thought as well, that first I need the get the GC and after receiving it I can apply for the reentry permit...

You don't need a re-entry permit. Make sure you get your name on his orders and you're good to go.

05/2007 - got married in Germany

05/2007 - filed I-130 via DCF in Frankfurt

08/2007 - interview to prove bona fide marriage

09/2007 - hubby PCSed to GA

10/2007 - hubby deployed to Iraq

04/2008 - hubby on RnR in Germany

08/2008 - received CR-1 visa

12/2008 - flew to GA alone to welcome home the hubs

09/2009 - PCSed to CA

03/2010 - we're pregnant!

06/2010 - applied for German "BBG" to retain German citizenship during naturalization

08/2010 - BBG granted

09/2010 - filed ROC

12/2010 - received 10 year GC

12/2010 - our little miracle is born!!!

01/2011 - PCSed to Germany

01/2012 - filed N-400 for overseas naturalization

03-15-2012 - Best of Both Worlds, I'm a dual citizen :-)
