I and my husband are filling concurrently I-130, I-485 and I-765. I have a question about the I-765

1. I am currently F-1 student with a valid SSN from DHS to work on-campus, never work off-campus so am I considered as renewed EAD or initial EAD?

2. What category of my eligibility that I will fall into? ©(9)- Adjustment Applicant?

3. Is there a fee for I-765 since I read the exception for fee waiver and it not includes the ©(9) category?

12/03/2012: Biometric Appointment Received- Schedule to 12/19/2012

12/04/2012: Biometric Walk-in Successful, Chicago Office

12/10/2012: Request Expedite EAD

12/12/2012: Approval EAD, rec'd emails & text.

12/18/2012: EAD card sent

12/20/2012: EAD tracking said it was delivered.. still not rec'd.

Your current EAD is under a different category. You are adjusting your status because you are your husband's immediate relative. New EAD reflects the new status category which I believe changes with your application. So yes, you need a different EAD that reflects that.

There is no extra fee when filing concurrently with I-485. Yes, you are c9.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

You never needed an EAD to work on campus. Your SSN card should have sufficed for campus jobs.

So unless you applied for an EAD and got one previously, This should be an initial EAD application not Renewal
