Hi, I thought some may be interested in the following:

My situation is, arrived in the US as a tourist and then out of the blue got married to my wife.

8 Feb, Sent I-130, I-485, I-765, I-131 and G-1145

9 Feb, Package received at Chicago Lockbox

14 Feb, Email of acceptance, application being sent to NBC

15 Feb, $1070 check cashed.

Things seem to be moving pretty fast at the moment.

Couple of questions,

Do you think it will affect the speed of my application that I have held a J1 visa here before and lived and left with no problems?

Do I have to have the biometrics appointment before I can get the EAD?

Any guesses on how long I need to wait for my EAD to come through, I'm not happy not being able to support my wife.

Update:

Just checked and I all my applications are now appearing on the USICS tracker thing. All but the I-485 have moved to initial review? Does the I-485 normally take longer?

Does the fact that the rest are at initial review mean that we completed the applications correctly? I'm very paranoid that we might have made a mistake on one of the forms and may get a letter saying I have to start again.

I-485 is APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, this should stay under Initial Review until you get your interview letter. Then it will move on to Testing and Interview. This is the one that requires the interview if you AOS in U.S. So yes this takes up to 6 months.

EAD generall comes within two months. Holding a prior J-1 visa will not count against you.

The only thing that matters is that you were lawfully inspected and admitted to the United States, that you are in a bona fide marriage, and that you have a sponsor who meets the federal income requirements. Assuming you meet these qualifications, you have nothing to worry about.

I agree with Harpa here. My EAD came a little after 90 days (you can get an InfoPass and get a temp EAD if the processing goes beyond 90 days -- so expect 90 days max).
