It's not a waste of energy if I can shave two weeks or more of waiting time off. However, I understand if you don't have the energy to read it; I won't be offended.

Harpa is absolutely right. You will not shave off anything. There are so many possibilities it is like trying to guess someone's pincode on the ATM card. If you want to waste your energy by chasing various possibilities it is up to you. All it does is make you nervous. Wait for RFE. You cannot respond to RFE until you receive it any way. Usually, it takes 1-2 days to satisfy RFE and send it back...

So, everyone was wrong who had money in the pot. I got an RFE for something else.

so what was it for?

Mine was that my divorce decree did not say anything about the divorce. I have to wait till the 27th to go to court and get it corrected then send the amended decree in. Hope that satisfies that.

I didn't lie on the petition, because none of the crimes they asked about applied to me.

Yes.....but.....you pulled an RFE.

Does your fiance know about all these probationary requirements and background?

You don't need to disclose anything to us....but she NEEDS to know everything.....you can be assured that this will be mentioned or asked or her at the interview....especially to pull an RFE.

Also she needs to know that the CO may ask her pursposefully misleading or false questions relative to your background.......do not be casual about all this. It may or will happen and her response may dictate entirely if she is granted the visa or not.

This IS NOT something to be casual about. If you want PM me and of course all will be kept in confidence....but your story and their result is not lining up. A crime is a crime and they take everything and know everything seriously. What if they deny the visa for her? Are you ready for that?

They want certified copies though. I'm not sure if I should provide, or if I can even get, a certified copy of my discovery. I have a certified copy of my order of probation though... I'm also going to get a letter from my probation officer.

Yoiu need to give them everything you can. They can want everything they want and you have NO choice in the matter....or accept denial.

I have the discovery and a certified copy of my order of probation, but they're all from the year it happened (2009). My fiancee knows everything about my background, and she has known since we first met. Many of the pages in the discovery are only available to attorneys. Some of them are marked "RECEIVED DATE", and some have notary signatures. I am able to get a letter from my PO to fully support my case; he has known about the K-1 and my relationship with Anastasia even before the K-1.

If she is denied a visa, I've already decided to save enough to spend the month it'll take over there to get married. If I find a job while I'm there, I'll probably stay.

OK, know that becoming married doesn't really change the RFE issue and any denial of any type of visa. Obviously your "past issue" means something to the USCIS for them to RFE it, regardless if "it" is on their list or not!! And your fianc'e knowledge of it will be good for her interview but doesn't change the fact that unless you can satisfy the RFE here in the states, she may not get a chance to defend herself about it.

Maybe it is nothing but providing them with more documents... and I truly hope that is the case....but you seem to have a Plan B in mind just in case.

I know that having something like this in my past is going to cause a lot of roadblocks for us, similar to this one, in the future. Thankfully, adjudication was withheld. So, I can have this record expunged or file for clemency.

My biggest dilemma is whether or not I should use this letter provided by my PO dated on January 12, 2012 that was drawn up to send for my fiancee's interview, or if I should wait about 4 or 5 more days to get a new one for this specific event. Most likely, it would be the same thing, but the date on the form is causing me concern. USCIS isn't requesting it, but I believe it would help. I wonder if since they're not requiring it if the date is important. My PO has already agreed to write the letter...

I'm also going to provide employment verification and enrollment verification (with transcripts). I believe that should help establish character. I do have a 3.4 GPA, and I'm in my last semester for my B.A.S. I've been attending school for nearly 4 years without taking one semester off (including summers).

Our case got upgraded after 3 months on Feb 14th to RFE. I was so happy at first, but now reading all your comments above .... what does it mean? Is this A PROBLEM or this is normal. Apparently they need more documents showing we spent at the same time in the countries we've mentioned we met each other in.

Now, should I be worried???!!?? :( How long does it take to inform us again? I was so happy cause our initial review took only 3 months and NOW ... what will happen?

Our case got upgraded after 3 months on Feb 14th to RFE. I was so happy at first, but now reading all your comments above .... what does it mean? Is this A PROBLEM or this is normal. Apparently they need more documents showing we spent at the same time in the countries we've mentioned we met each other in.

Now, should I be worried???!!?? :( How long does it take to inform us again? I was so happy cause our initial review took only 3 months and NOW ... what will happen?
