Hi guys

I am waiting for my NOA2 now, when I am reviewing my case some of my problems really worry me. Please help:

1. My husband invited me to went to USA for a business trip(back then we were just friends not dating was looking for a chance to do busniss)so thats how I got my B1 visa.

2. We got married in USA

3. I overstaied for 14 days

4. Embassy fraud Dept. Officer reported about me for overstay and maybe possible said I went to USA was our plan from the begining(I am just guessing he might said that on the report).

5. Big age difference.

Now we are applying for CR1 visa, the listed 5 red flegs(sounds like red flegs to me)worry me alot.

Anybody with expenrice how difficult my interview will be?

I am thinking the best result from my interview would be blue slip which is soft denial. I dont know. This whole situation looks pretty nasty to me.

1 and 2 are not red flag.

3 is, sort of, but it is a very short overstay, shouldn't be a major issue.

4- are you sure? Is this someone you know personally? Seems an odd thing to threaten.

5. Depends on who is older and how this is seen in your culture.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes I am sure, he called my husband said he is gonna report me. I am sure there is an report about my overstay but I dont know how nasty that report is,he is not somebody I know personally, he works for US goverment, at fraud dept. :(

He is older than me.

Usually red flags issued are handled by letters of attestation with accompanying evidence.

Usually.

Also, for a K-1, is best to submit the letters of attestation with the I-129F submittal. Is rare they are accepted on interview day at GUZ IV, though you could try - in the first 30 seconds of the interview. After that first 30 seconds, though - the VO's attention is elsewhere.

I think 4 is still hearsay, even from a US Government Employee - the effects of an overstay vary, but remind us all again - why and when in WHAT PROCESS did the fraud investigation unit get involved?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

The report is not a hearsay, I am positive and I know for fact that I do have a report on my profile.

Thats why I am so worry.

The reason I have someone reported me from fraud dept. is bcs he talked to my husband when I apply for B1 visa. back then my husband was only my friend who wants to do busniess with my company tho.

So he got involved in my B1 visa application thats why he called my husband said he will report me and he did.

Now how bad is that?

P.S: I am applying for CR1 not K1. we do have letter explain why I overstay.

ok - so 'when applying for B-1 visa' , is not the same 'timetick' as 'returned to CHINA after 14 days overstay'.

I say 'the man' did nothing after you returned from USA; instead a regular report of overstay was put in your casefile, instead.

Unless you have more to add ? [sorry, I only surmise based on what you've written]
