well is two deferent things i think. Going to my brother inlaw's graduation with almost every one in the family will be going. and going as a tourist. what ever the name of the visa is, i don't know. and for saying my desire is to immigrate rather than to live in my country because of my I-130 petition, i think i should ask if u know of a petition that says WIFE will be with the husband or HUSBAND will be with the wife in the U.S.A without immigrant visa. If there is one let me know and i'll show u how i desire to live in my coutry.i filled that because that is the only way i can be with my husband but not that i dont desire to be in my country. if you have job here in my country to offer my husband, he will gladly come and stay in my country with me not the other way round so u can know i desire very to live in my country. don't snub me again pls.

OP- I read here frequently that some countries are more difficult than others to get visitor visas from. I also see most threads on this topic consistently indicate that strong ties are a key part of what CO's look for when considering a visitor visa. But, to answer your question, yes, it is possible to get a visitor visa while an immigrant visa is pending. Late last year, my wife was granted a visitor visa from China (one of the so-called difficult countries) and definitely stated on the application that we have a pending CR1 application and that the purpose of the visitor visa was to visit her husband.

I do not want to give false hope for any particular situation, but I felt compelled to share our experience because I see so many responses from others that state it is impossible to a visitor visa while an immigrant applications is pending.

It is (usually) difficult, not necessarily impossible. Much depends on the reasons that the foreign spouse has to return....lacking those, it will be an uphill slog.

the major concern the VOs will have (collectively) is this:

Once the foreign spouse arrives in the US, how likely will it be that the Amcit spouse decides to head for an AOS versus sending said spouse back to country X for an I-130 interview? Regrettably, because sooooooooooo many people have had this 'mind change', it makes it more difficult for those who may not really wish to do this convince a VO otherwise, especially if there are virtually zero reasons for the alien spouse to return (having elderly parents is NOT a reason....because the foreign spouse is on the cusp of leaving them permanently in the near future)...without a meaningful job or ongoing education, it will be a tough sell.

There are conflicting information on the issue of a tourist visa for applicants with a pending immigrant petitions.

I called the department of state about it and they said yes you can get the visa.

I applied and the visa was approved. However, while in the US, USCIS official said she was surprised I was given a a tourist visa when I had a pending petition.

I think each case is determined based on its own merit.

Prior to this application, I was previously given a tourist visa to visit my fiancee even before we put in our petition. I was given a single entry visa and I was specifically instructed to return back to Ghana before a certain given date and report to the embassy. I was also cautioned by the CO that failure to report back to the embassy wil affect all my future applications.

I did exactly as I was told hence I had no difficulties with my second application. In fact the problem of my pending petition did not even come up during the interview.

I'm currently back in Ghana after my second visit.

Your situation may be different but I think you can still give it a try. Nothing is impossible.

You have a terribly sad understanding of what I said & therefore what is relevent in your situation. The fact that you have a pending immigration based petition alone will be enough to cause a denial of any attempt to get a tourist visa. Its up to you & not me to convince the embassy that you intend to return. That you cant do. Even if you did you would probably not be allowed entry into the USA. Best thing to do is pay the money & walk up to the window. I have a feeling you will do very well at the interview.

If you dont want to immigrate to another country why bother with an immigration based visa?

If you feel "snubbed" try to get over it. I dont even know what that means.

It's a common mistake to take specific advice given in a specific situation and apply it universally.

My assessment that this OP's spouse has zero chance of getting a visitor visa is based on the facts that not only is it Ghana, but the foreigner has no job and is pregnant. Somebody with a good job and good ties to their home country, has a much better chance but still slim in most cases.

Consulates like the one in Accra are happy to accept visa application fees for visas that are never issued. It's great for their budgets.

Facts are cheap...knowing how to use them is precious...

Why do people ask for advise, then they turn around and be RUDE to the person who is giving them advise. I always say, if you don't want to hear what has to be said, then don't ask. You would be better off taking everything that has been said into consideration and decide if you are willing to spend your $150 toward this lottery ticket. You may win, then again you may lose, but the final decision will be up to you.
