My husband will visit me again next month (:dancing:). January 24th was our 1year annivery and we are in the second month since I-130 and I-129F(already got NOA 1 for both).

My brother inlaw will be having his graduation and since all my husband's family will be there, they want me to follow my husband for a vissit when he is going from his March visit so that we can all meet in the States during the graduation because none of them were able to make it to our wedding.

Now my question is,i'm no more working (i was a secretary), we don't have baby yet so i dont know if i'll be given the visa since even though i'm from Ghana and have families, i dont have the above 2 strong reasons they may want. the fact is i will surely come back to wait for the I-130.please help us on what to use to prove that i will come back?. :help:

With no job it will be very difficult in Ghana. My brother-in-law works for the Ghana Government with a very good personal income and was not approved. If you want to try you can bring evidence of personal ties (both brother and sister in law had pay stub, rental agreements, letters from ministers saying their work at the church and ties to family they support). Neither were granted visas.

Good luck if you try- especially with a pending CR-1, and they know you have applied so defiantly will come up in interview

I think you are asking about a tourist visa. You will not be granted a tourist visa with a pending 130 petition. This always comes down to the persons ties to their country. Your petition indicates your desire to immigrate rather than live in your country.

well is two deferent things i think. Going to my brother inlaw's graduation with almost every one in the family will be going. and going as a tourist. what ever the name of the visa is, i don't know. and for saying my desire is to immigrate rather than to live in my country because of my I-130 petition, i think i should ask if u know of a petition that says WIFE will be with the husband or HUSBAND will be with the wife in the U.S.A without immigrant visa. If there is one let me know and i'll show u how i desire to live in my coutry.i filled that because that is the only way i can be with my husband but not that i dont desire to be in my country. if you have job here in my country to offer my husband, he will gladly come and stay in my country with me not the other way round so u can know i desire very to live in my country. don't snub me again pls.

It would be a B2 Visa (Visitors) no other choice. Again- hard to get in Ghana. My husbands (fiance at time) siblings were trying to come for the wedding.

You have a terribly sad understanding of what I said & therefore what is relevent in your situation. The fact that you have a pending immigration based petition alone will be enough to cause a denial of any attempt to get a tourist visa. Its up to you & not me to convince the embassy that you intend to return. That you cant do. Even if you did you would probably not be allowed entry into the USA. Best thing to do is pay the money & walk up to the window. I have a feeling you will do very well at the interview.

If you dont want to immigrate to another country why bother with an immigration based visa?

If you feel "snubbed" try to get over it. I dont even know what that means.

The truthful answer is that a Ghana Citizen in the middle of a spouse visa process, who also has no job in Ghana, has zero chance of obtaining any visa to enter the USA, other than the spouse visa they are currently pursuing. Nobody here expects you to like that answer, but you would like it even less, if we lied to you.

My advice is to save your time and money. Don't even attempt to obtain any visitor visa. You may do as you wish with this advice. It will not change, based on your feelings about it.

Moved from IR-1/CR-1 Process and Procedures to Tourist Visas as this is the visa type the OP is inquiring about in this thread.

*Organizer hat off*

I agree with Ning and Pushbrk, the chances of obtaining a tourist visa given the circumstances is zero.

With Ghana do not even try. I watched the Embassy turn people down over and over the day of my interview. I do not think they approved one tourist visa. I agree with others do not waste the time or money.

It may be low, but not zero.

That's also what they say about lottery. If you don't buy then you don't have any chance of winning :)

Personally I don't think 1 in 14 millions chance is that much better than zero but people who buy lottery buy a dream and they could easily afford a couple of dollars a week without hurting their economy.

So by all means, if application fee is not an issue for you, do apply and find out but don't expect to get it.

But if money is tight for you right now, then save the money and spend it on something realistic instead!

Tourist visa (B1/B2) is issued when you are able to convince the CO that you are only visiting and have no intention to immigrate. In your case, you have already expressed your intention to immigrate by filing form i-130 so your chances of getting approved is virtually nil. It may work for someone living in Europe where there is adequate economic opportunities but it will definitely not work for someone from Africa...call it discrimination in any language or whatever definition you find it in harmony with, that's the reality. Except you have enough money to blow $160 away, don't even try.

if money is not a problem give it a try. i think i have seen someone here from Ghana who applied with a pending K1 application at USCIS and i think his application was approved while he was in the US. but the problem still remains, you don't have enough ties in Ghana at this point.

if you decide to go ahead and try for the tourist visa, be honest with the CO.

also i think you should make some research about tourist visa. the bases upon which is its granted. when you apply for a tourist visa, you are considered to have immigration intent and its up to YOU to prove the CO otherwise - something which will be difficult for you considering the fact that you dont have a job and have a pending immigrant case.

all the same as i said, if money is not a problem right now, go ahead and give it a try. it will give you an experience on dealing with the COs at least.
