Thank you guys for your specifications. as my fiancé is not the petitioner of the divorce and lives oversea right now, how can he obtain the right final divorce decree from the court clerk? do you have any idea about that?

I went to the county (where we divorced) clerk's website to get the phone number and mailing address. I called them and got the fee requirement and instructions. Then I mailed a typed request identifying the parties and case number and the number of copies. They mailed the requested certified copies within a week.

Instructions are "If either you or your fiancé(e) were married before, give copies of documents showing that each prior marriage was legally terminated." which I want to say you have. The instructions are not specific to the final decree being recorded (those would be the stamps and seals, noting it has been recorded). SO maybe you are ok. Normally, when you get copies of a divorce decree is already recorded, and petitioner/defendant cannot get a copy until recorded. If judge has signed then it is final. Only thing left is to record it but (I am not a lawyer) I'd think that recording it is not part of the 'terminating' the marriage.

In any case, I'm afraid you would need to wait for a RFE. You refer to the "right final divorce"..Do you mean the one recorded?

The one we sent first was a page with nothing write there as "divorce decree" one thing is sure it was not the divorce decree, it had no stamp, no signature, no seal, a paper saying that the divorce will be pronounced after the presentation of some document. and the one we found now is a final divorce decree, 4 pages, with signature of the judge, but still has no stamp and no seal.

Most don't have a stamp or seal. The one I requested had a stamp on it from the recorders office stating it was a certified copy. But the Judge just signed and dated it, no special stamp or seal.

Pushbrk is knowledgeable, and to his credit states facts not guesses. When I first started researching on VJ everyone had opinions and I found out the information was not accurate on some and simply an assumption on the posters part. IMO Pushbrk not only has a right, but a duty to discourage false information being provided.

And btw, if USCIS determines the document sent was not adequate, you won't be RFE'd. You'll be denied and need to refile. Because you must be free to marry to file.

I'm a bit afraid of that, because the date we used to file the G-325A of my fiancé was wrong too , that paper was issued one week before the final decree divorce we have now. so definetely the paper we sent was not the right one.

as you said we have now to waiting for the decision of the USCIS.

ok thanks, i just have a preoccupation now to be ready when the RFE will come. as appearently the divorce decree we have now is still not the right one. can someone tell me how to do to obtain the final decree with new seal, stamp and signature? (the probleme is that my fiancé is doesn't live in USA, otherwise it should be easy for him to get that.

Contact the court where the divorce took place. The court clerk will have the records and can provide a certified copy.

Did you state that he signed and dated the G-325A before his divorce was final? I would worry about that just because it asks in the form when the divorce date is. It seems you know this, i just hope you dont have to pay another re-filing fee later. God Bless.

No, the paper we used to file the G-325A was issued one week before the final divorce, and at when we filed the petition we thinked that it was the right one. it's 3 weeks after we sent the petition that we found the right divorce decree in his documents. it's why i was asking if we can send it now than waiting for the RFE .

Bonjour!

Welcome to the forum. My fiancee and I are in a similar situation. The copies of the divorce decrees that I sent in were the final court orders, not photocopies of the certified copies from the state Department of Health/Records and Vital Statistics. I only realized my error after I had submitted the petition. :wacko: I am expecting that we will be getting a RFE as a result. While I have been in the 5-minth waiting zone between NOA1 and NOA2, I have contacted the states' Department of Heath/Records and Vital Statistics (in my case, the states of Colorado and Washington) paid for and have obtained a certified copy of the final divorce decree from the aforementioned various state agencies. I found the web addresses for the state agencies by simply doing a Google search. It took a couple of weeks and $20 to $30 to obtain them. I will be ready to respond promptly to the RFE and hopefully not delay our visa journey too much. I thought it best to wait for the RFE, rather than sending the photocopies now, and hope and pray that these two needles in the CSC "haystack" get matched up.

It will all work out in the end. BTW, while you are waiting..... :time:

Denial would only occur for a wrong divorce decree if the petition was filed before the divorce was final. Otherwise, there would definitely be a request for the proper documentation before any final decision.

Facts are cheap...knowing how to use them is precious...

VJ is a Forum. A discussion site to ask a question and review answers and make the best choice based upon your situation. There are No Lawyers here. Just personal experinces or opinions. There is NO GOD HERE.

You have to read and see OPINIONS. That is all. You in the end have to evaluate what is best for your situation.

I gave a personal experience from a RFE and this what was asked. NOA2 in less than 2 weeks. A Personal Experince. Not a Guess...

I don't give a ####### if I was wrong or right. It accomplished the Goal and was accepted by USCIS.

If you love Pushbrk's so much then Vote to eliminate E-Wok and Vote for Pushbrk. I wonder. ???

I dont want to bring too much drama here...BUT "Tim/Mav" why you have to put your thoughts in such a nasty way ??? :wacko:

Stay PRO - VJ members need help and support...I don't think you were THAT experienced from the beginning when you just start your "visajourney" for your fiance :innocent:

And what I know from MY experience now being already here in USA with my husband....you gonna have a LOT of questions what to do next reg. paperwork ...I bet NONE of the VJ members will respond you the way you did here... :(

Right, OK.

So when I proposed to my now wife I had no idea there even was a K-1 but figured there had to be something. I googled something about wife visas and came up with this site and started asking questions. Pushbrk answered most of them and seemed pretty straight forward and plain speaking which I admire.

Now I have been through the whole process and Alla is now a citizen and we never had an RFE or a question asked at an interview until the citizenship and even that was no problem and I thank Pushbrk for that over anyone else (not to belittle the others here and there are plenty) but Pushbrk was always eager to answer, always correct (being correct makes it more than an opinion)

Pushbrk will also pay you the compliment of being direct. I have no use for polite idiots who make up answers that are not correct

I agree, I am glad you articulated that. I just think if a person is expressing an Opinion, they should state that (myself included).
