The advice from some is there. You have to decide what path to take. Remember, you have to do what YOU feel.

Well , about asking a new copy with a new seal, stamp and signature can we ask it from the courthouse by mail? because my fiancé is not in USA now, he lives oversea.

Hi VJ family, i'm new in the forum, and i wanted first to say thank you to all of you for all the informations and assistance provided.

here is our situation, we just sent a petition for a k1 visa fiancée and 3 weeks after that we found that the divorce decree was not the right one. so we are pretty sure we will get a RFE for the absolute finale divorce decree. so we really need your advices, should we send the right final divorce decree now or what?

ok thanks, i just have a preoccupation now to be ready when the RFE will come. as appearently the divorce decree we have now is still not the right one. can someone tell me how to do to obtain the final decree with new seal, stamp and signature? (the probleme is that my fiancé is doesn't live in USA, otherwise it should be easy for him to get that.

It does not need to be an original certified copy of the divorce decree, they only request a copy of the certified decree, states so on the instructions. You're not being picked on ... you are just wrong as a copy is just fine .

Very unprofessional to have a peeing contest when someone is asking for advice..... My advice is WAIT. If you send something in now you risk it not reaching the file or miscommunication. There is a chance that they may overlook that the document that you sent is not a certified copy. But there's a chance they might not. Simply wait and prepare. Order a certified copy from the court. Call the court to figure out how that is done for that particular jurisdiction. Good Luck.

Once again, Tim, you're making it up as you go along.

Although it sounds to me like you know what you are talking about and I DEFINITELY appreciate accurate and thorough responses I feel like there are several times I post things I think to be fact, that turn out to be opinion.

Everyone has been SO nice and helpful for me on here and I think my favorite part of this site is the nice people willing to help out.

If you disagree with another persons post I think there is a nice and more appropriate way to respond.

You have to contact the state he was divorced in. We don't know what that was. Don't get hung up on one member's "description" of what they look like, because that varies from state to state.

OP I believe Pushbrk is correct. USCIS asks for copies. If you already have a correct copy, Keep it and be well-prepared to send the correct copy back to USCIS (next-day air) as Gary&Alla and Hank&Amy sugggested. If you look at the I129F instructions Section B, Question 5(d) there is no mention certifying the "copies" or that a Decree is mandated, only proof of the divorce. The Decree is typically the easiest to produce for evedince.

If he knows what county the divorce was filed in then he can use google to determine if the county has an official website (most do). There should be instructions on the county's website for obtaining certified copies of the divorce decree from the court clerk's office (or whomever is the official custodian of those documents). You can send a photocopy of this document to USCIS.

I live in California. I had a prior divorce in Ohio. I found the website for the county where my ex-wife lived when we divorced, I followed their instructions, filled out their form, included a photocopy of my ID (per their instructions), and a check for the fee (was only $3 or something), and mailed it to them. I got the certified copy about two weeks later.

Instructions are "If either you or your fiancé(e) were married before, give copies of documents showing that each prior marriage was legally terminated." which I want to say you have. The instructions are not specific to the final decree being recorded (those would be the stamps and seals, noting it has been recorded). SO maybe you are ok. Normally, when you get copies of a divorce decree is already recorded, and petitioner/defendant cannot get a copy until recorded. If judge has signed then it is final. Only thing left is to record it but (I am not a lawyer) I'd think that recording it is not part of the 'terminating' the marriage.

In any case, I'm afraid you would need to wait for a RFE. You refer to the "right final divorce"..Do you mean the one recorded?
