I-134 or 1-864? Need info for packet 3

So trying to prepare everything well in advance and went onto the Montreal US Consulate website. On the appointment checklist for the fiances visa, it is asking for the following forms - Evidence of Support (I-864,I-864,I-864EZ, I-864W) - no where does it list the I-134. Is this some new form for the evidence of support? And if so, do all of these have to be provided? My fiancee has his own business - what will he have to provide besides bank statements and tax returns?

Does Montreal require both Birth Certificates? Mine (beneficiary) His (petitioner)?

He is divorced and I know that the divorce decree is required but do they need his marriage certificate as well?

What is the biographic page of the passport? What is english translation? Do they need his passport and biographic page as well?

Do I have to go to the social security office to obtain my EAD? Is there a cost involved for that? If so, how much?

What is the AP? Is this for advanced parole? I keep seeing AP, EAD mentioned in the same sentance on alot of post and am asking for clarification

AP is advanced parole EAD is the employment authorization. This are filed for after marriage when you file for AOS - don't even worry about thos things right now.

Bio page of the passport is the page with your picture and information on it.

Men do not need a marriage certificate, only the divorce one - if it was a woman you need the marriage and divorce certificates to show the name changes.

in 2009 Montreal asked for both mine and his ( birth cert ) at the interview but returned both originals and kept copys. ( Always ask for originals back and leave them with copys )

Montreal lumps K-1 information with spousal information. Unless they changed the requirements within the last few days to require the 864 - they should only be needing the I-134 for the K-1.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

There is a new link for packet 3 at Montreal. They no longer require the I-134 for K1 visa. It is the I-864 now. Here is the link for you to have a look at.

There is a new link for packet 3 at Montreal. They no longer require the I-134 for K1 visa. It is the I-864 now. Here is the link for you to have a look at.

Okay...this is totally confusing!!!!

The original montreal website listed in the first post does not work.

And, there is no evidence on the site posted above, that states either form 1-134 OR I-864 are needed in packet 3.

And furthermore I am so confused about wording.

In an older Day of Interview Checklist I had printed out from Dec/11 it lists Affidavit of Support (I-134) and Evidence of Support (I-864) are needed for the interview.

Today, I found on another Montreal website (http://montreal.usco...-checklist.html) only Evidence of Support (I-864) is needed along with photocopy of the IRS transcripts or photocopy of the most recent tax return are needed.

But when I research form I-864 it is called 'Affidavit of Support' not 'Evidence of Support' as listed in the checklist. When researching this form it indicates this form is used for adjustment of status purposes.

I find I am getting so confused with terms and titles of documents/forms being referenced 'loosely' and procedures changing. I am not sure what to get prepared.

The website you found today is the one that I posted the other day in a reply, which is the NEW website for Montreal. The evidence is there, if you click on the checklist on that page it shows the I-864 is required. They now require the I-864 for K1. Up until they changed the website they were still one of the consulates using the I-134, I guess they decided to catch up the times and go with the I-864 too. If you research the I-864 on VJ you are going to see it used for AOS, because it is used for that also. Prepare and take the I-864 to your K1 interview, as that is what they require now.

i was checking the link with the checklist, there's a part that says: " Form DS-230 (175KB PDF), part I, or Confirmation Page of the electronic form DS-260" . If i understood right, You DONT NEED this DS260? Its says confirmation page .. confusing.. Help! thx

This whole I-134 vs I-864 thing is making me nuts.

I found this today on the usvisa-info.com site:

No mention there of the I-864.

I emailed Montreal to ask about this issue earlier this week. I'll post here when I get an answer back.

The K-1 Visa journey for myself and my two K-2 children:

K-1: NOA1 2011-8-10; NOA2 2012-1-12; Interview 2012-4-24; Visa issued 2012-9-17; POE (Sarnia) 2012-9-26; Wedding! 2012-10-02

ROC: NOA1 11-7-14; Biometrics 12-1-14; 10-yr Green cards ordered 4-13-15! (157 days total)

Counting down to naturalization time!

I find this I-134 vs. I-864 thing confusing as well- I wonder if they just forgot to include I-134 in the checklist as they also lumped some things only spouses need in there too? But if they made the switch, maybe it'll be easier on K1s since part of the adjustment of status forms will already be done... :blink: I do recall reading somewhere that technically Montreal can ask for a K1 to submit and 864 if they feel there is insufficient evidence, so maybe they're just trying to kill two birds with one stone.

I am hoping that someone can post the most up-to-date documents required for packet 3 and 4 K-1 Visa only. Some of the information that I am finding is outdated or pertains to spousal visa.

I also am wondering if I can start prepping my packet 3 and if I can send that information to the consulate beforehand even though I haven't received the packet 3 or instructions from the consulate yet. Do not send Packet 3 until DOS says it has been logged. Despite what a DOS operator may say, you do not have to physically receive packet 3 in the mail before sending it, but it DOES have to be "logged" in the system i.e. Montreal is in the process of sending it out. Montreal is notorious for sending packet 3 and packet 4 very late or never sending them at all, so if you wait to get in the mail it will set you behind. Keep calling DOS a couple times a week or so until they tell you that Pkt 3 has been logged. Same for Packet 4, just call to find out it's been logged and then you can schedule an interview.

Packet 3 is just a letter that directs you to their website to print out the forms and send them back, so it's not any new information.

Look at the checklist on the NEW link for Montreal. It absolutely does mention the I-864 as one of the required documents. It's not listed in the forms needed with packet 3 because it does NOT get sent with packet 3 it goes with you to the interview along with the other things on the checklist.

That thread needs to be updated. There is a new website for Montreal, the one posted there is the old one that 'cannot be found'. That is why there is so much confusion with things. Montreal now requires the I-864 instead of the I-134 for K1.....They are finally catching up with the rest of the world.

I didn't mean that your post needed to be updated. I meant the post by Raylse had to be updated because the link in it is the old one.
