Timeline

So I went to a SSN office today to apply for a SSN and was told I do not qualify. She determined this just by looking at my K-1 visa. I tried to explain to her and had info from her own offices web site showing her that I did and she refused to even look at it and just said kept saying no. I think it annoyed her that I was persisting. She then stated she had to read me a declaration and that I had to answer some questions. I said okay and she read the declaration then started typing away at her computer and said "okay we are done". I asked her about the declaration and the question she had just said she was going to ask me and she said no need as I had been denied. So I asked her why she bothered reading the declaration as she denied me before reading me the declaration. She then said she actually just took the answers off my application and used that as my declaration answers. I told her if I was declaring something I would like to know what the questions were and she refused. I asked her twice more and she refused me each time. So she made me swear a declaration and then answered the questions herself and refused me 3 times when I asked her to let me answer my own questions. I am very upset and angry and worried about what she put in as she seemed annoyed from me pushing and saying that I am eligible for a SSN on a K-1.

When did you enter the US? You need to have at least 2 weeks left on your I-94. If you do not, then you need to wait until you have your EAD or green card.

You could have asked for a supervisor and explained what the office worker was doing to you and how you were treated. You can go to the main SSA site and contact them through an email. Let them know what happened and how you were treated. If you know for sure you have enough time left on your I-94 and are indeed eligible, let them know that in the email too. Give them all the details you can. They have been known to send a letter back that you can print out and take to your SS office that tells them you are indeed allowed to have an SSN and they are to give you one.

I'm a little confused, your timeline says you entered the US on September 25, which means your I-94 would have expired on December 24?

She does sound she dealt with you in a very rude way.

Feb 24 is two weeks from today. I think you may have missed your window. That woman does sound rude and deserves a complaint anyway, though.

I had applied on Feb 9 and didn't make my post until just after midnight making the post Feb 10. I therefore was within the time frame by one day. I have actually filed a complaint and am waiting to hear back from the main SSN office. So I am moving along for now.

I am now trying to apply for a ITIN number and the IRS requires a certified copy of my passport. However I went a couple of places (a DMV and UPS store) to have it certified and they said they do not actually certify a copy the only thing they can do it certify a statement by me saying it a true copy. So I called the IRS and asked if that would acceptable and was told no and that he had never heard of that. So my husband and I looked online at the California legislation for Notaries and sure enough they can only do what they said and sign off on a statement that I signed in front of them which the IRS will not accept. How the hell am I supposed to get this done? Please anybody have any suggestions?

Tax preparation offices like H&R Block are able to say your passport is legit for the W7 (I forget what this power is called...agents of acceptance or something like that). My tax prep person was able to "notarize" the validity of my husband's passport so we could file for an ITIN. I'm not sure if they'll do it for you if you aren't having them file your taxes for you, but my guess is that they would.
