Thanks guys but this is what I got from the US Embassy in Manila

Here's the response I just GOT TODAY;

Fiancé(e)s of U.S. citizens (K1) are required to submit a I-134 Affidavit of Support from the petitioner together with a copy of the petitioner’s most recent Federal income tax return (Form 1040).

The minimum income requirement for Form I-134 is 100% of poverty guidelines.

If the petitioner is unable to provide a Form 1040, he must submit other credible evidence of assets to meet Federal poverty guidelines for his prospective household size. Such assets could include bank accounts showing the date the account was opened and the present balance, stock, personal property, real estate and non-taxable sources of income such as Social Security payments which should be available in the U.S. for the applicant's support and must be readily convertible to cash within one year. The consular officer determines if any additional documents are needed as the application is processed.

You didn't save tuition receipts? Do you realize that under some circumstances that is tax deductible? Anyway, you should be able to get a letter from the registrar of your school stating what dates you were a full-time student.

I have no idea why your letter said 100%, I've always seen 125%. And if you really hope to support 3 people here, 125% is a lot better to have than 100%! I would not count on them only putting you down for two people, they will know your wife is pregnant.

Yes, we all know the requirement for an I-134 is 100%. However, most consulates go by 125% for a K-1 because you will need 125% for AOS in the very near future. A K-1 is often treated as an immigrant visa at the interviewing consulates. The interviewing officer does not have to accept 100%. They do not even have to accept the bare minimum of 125%. It is solely up to their discretion.

Also, once your fiancee and child arrive in the US and you get married within the 90 days, she will need to file to adjust her status. You will have to provide another affidavit of support, this time the I-864. It requires no less than 125% and is a legally binding contract, whereas the I-134 is not really.

Yes, though old affidavit versions are currently accepted, the newest form as of today, 2-10-2012, requires letter from bank, including current balance, and amount deposited in the past year. The employment letter requires salary, start date, and employment status (ie permanent or temporary). this is all outlined in the form's instructions.
