I & my husband are both on H1b. We got married in India but didnt get time to register our marriage and we returned to US back. Now my husband's PD is current, need to apply for 485 and i need to add my name in his GC.

We do not have Registered Marriage Certificate from India, however we have :

1. Husband's new passport has my name in it as Spouse

2. Affidavits from both parents stating they attended our marriage.

3. Marriage Certificate from US Consulate stating "As per his passport, I am married to him"

Our query is:

1. Will the above documents suffice to add me on his GC ?

2. Has anyone experienced the same & received RFE or got cleared ?

3. Any other supporting documents will be required ?

All your help will be highly appreciated.

04/11/2007 - AOS from J-1 to B-2

07/10/2007 - Out of Status

08/26/2011 - Husband became USC through naturalization

10/12/2011 - We got married!

12/03/2011 - Sent AOS package(I-130, I-485, I-765) to Chicago Lockbox

12/05/2011 - Delivery confirmation via USPS

12/16/2011 - Received emails for I-130, I-485

12/22/2011 - Received NOA in mail for I-130, I-485 dated 12/16/2011

12/23/2011 - Received rejected I-765 due to missing signature

12/24/2011 - Received biometrics appointment on 01/09/2012 dated 12/20/2011

12/27/2011 - Reapplied I-765

12/29/2011 - I-765 has been delivered by USPS confirmation

01/04/2012 - Walk-in biometrics done

01/11/2012 - Received NOA in mail for I-765 dated 12/30/2011

02/01/2012 - Received text/email for I-765, Card/Document Production

02/06/2012 - Received EAD card in mail. YAY!

02/07/2012 - Received text/email for interview date, 03/15/2012

02/08/2012 - Received interview letter in mail

03/15/2012 - Interview at San Antonio, approved on spot and got a stamp!

03/23/2012 - Green card in hand! :^D

What do you mean by 'Marriage Certificate from US Consulate'? Can't you get married in US and get marriage certificate?

They are already married - they can't get married again.

According to the DOS, I am wrong anyway. It says here that 2 sworn affidavits can be substituted for Indian marriages, because registering them is optional for certain groups. http://travel.state.gov/visa/fees/fees_5455.html?cid=9215#docs

2/06/13: APPROVED!

Thanks all for the replies..

We cannot re-marry in US because his pspt already has my name & it would then change our marriage date.

That was a relief to know that 2 affidavits will do in place of our marriage certificate since we do not plan to visit India anytime soon for registering our marriage.

Anyone aware that marriage certificate from embassy of US & 2 affidavits have worked for them in I485 filing ?
