Joint Sponsor or Household member??

Hey guys,

So today we sent out the DS-230 part I and II with all the supporting documents, and now I'm getting everything ready to send out the Affidavit of Support stuff. I've got a couple of questions concerning it...

1. I have copies of my tax returns for 2008 and 2009, but in 2010 I was unemployed living with my wife in Spain. Will a letter suffice or do I have to have something from the IRS stating that I didn't file for 2010?

2. In 2010 I've been living in Spain and unemployed, so I need a joint sponsor or a household member. Here's my question...I've maintained my permanent residence at my parents house for the last 5 years as I was working out-of-state contract jobs and never resided where I was working. With that said, can I file I-864A with my stepfather, even though I'm currently living in Spain? Or do I need him to be a joint sponsor only and he doesn't count as a household member? He has written and signed a letter of explanation that although I'm temporarily in Spain that I've maintained my permanent residence at their house and that we intend to live with them until we get on our feet.

I have all the necessary information from my step-father (3 years tax returns, 6 months pay-stubs, I-864, I-864A, passport photocopy, and the letter of recommendation), just wondering which route to go and see what you guys think!

For 2010 just hand print in that section. "Not required to file. Income below threshold." Your father, as head of household would file his own I-864. You are not combining your income with his and it's the only way to properly account for HIS household size. You don't need to be counted in his household.

If you are currently living in Spain, you have no income to combine with your parents. If your parents are combining income, then yes, I-864 from you, same from your dad and an I-864a from your mom.

If you are currently living in Spain, you have no income to combine with your parents. If your parents are combining income, then yes, I-864 from you, same from your dad and an I-864a from your mom.

i'm gonna chime in here, since i'm also spain. but i currently live with my parents and am a full time student with part time jobs. my husband is living in spain. so, since my mom makes enough to be our joint sponsor, and they don't claim me as a dependent, i would assume she would fill out the I-864 and not have my step dad fill anything out, since her income is sufficient. Or would she fill out an I-864A since i'm living with her and technically am a part of her household? Also for a joint sponsor (I-864) do i have to show proof of relationship or is that just for I-864A?

If your mother and her husband file a joint tax return, it's usually best to have the spouse provide an I-864a. However, if the income can be separated, by providing a tax return with W2's, that shows the mother's personal income is sufficient, you can probably avoid the step parent filing anything.

Again, if she files jointly with her husband, you'll need a complete tax return with all W2's and schedules. A tax return transcript shows the couple's total income. If all you can get is a transcript, you'll need that I-864a from the husband.

Living with someone does not mean you are in the same household for tax / I-864 purposes. If they claim you as a dependent then you would be a household member but not through general cohabitation.
