Hi all,

It's been a while since I have posted on here, so a little background info...my wife and her (our) son came to America on a K-1 visa back in September, and we were married in November. Due to some financial difficulties, we haven't been able to file for their AOS yet, but should be in a position to do so soon. That being said, I am trying to figure out if I can bypass paying the fee for our son by legally adopting him. I am under the assumption that if I adopt him, he would be considered a US citizen, and therefore he would not need a green card, but I don't know if my logic is correct. I have tried asking my immigration attorney about it, but he doesn't seem to know the ins and outs of adoption laws, and he thinks it would be more beneficial to just file for his AOS along with my wife's and then proceed with the adoption later. Can anyone provide some solid info on this problem?

December 27, 2011 - USCIS - Received packet

January 06, 2012 - Received receipt notice NOA

January 14, 2012 - Received Biometrics appt letter

January 27, 2012 - Biometric appointment in Phoenix @ 9 am for I-485 & I-765

February 24, 2012 - Email received from USCIS they mailed RFE for I-485

February 29, 2012 - Received RFE for I-485 in the mail.

March 26, 2012 - Sent requested evidence (transcript 2010)

April 02, 2012 - Email notification that NBC received documents

April 10, 2012 - Received email that Travel Document was approved

April 10, 2012 - Received email that EAD was in production

April 13, 2012 - Received 2nd email that EAD was in production

April 16, 2012 - Received email that EAD was mailed

April 17, 2012 - Received email that NBC interview scheduled for May 18, 2012

April 18, 2012 - Received EAD/Travel Card in the mail

May 18, 2012 - Interview at Phoenix USCIS office

August 07, 2012 - I-485 approved

August 07 & 09 - Received email/texts from USCIS

August 15, 2012 - Received Green Cards in the mail

First, how old is the boy? If he is under age 14 the AOS if filed with his mothers is $600. I am going to guess that you will not find a better deal on costs of adoptions. If you do not do the AOS at the same time it will cost you the usual $1070 later

Adoption law is not immigration law. Adopting a child in a foreign country is one thing, adopting a foreign child that immigrated under another path is another thing. I think the lawyer fees to sort it out may cost more than $600.

I would go for filing the AOS and sorting out the adoption process at another time. IF your purpose is, as you stated, to reduce fees and costs, borrow $600 and include your son in the AOS filing.
