Hello VJ friends.

Today we had our interview for my greencard.

First the lady called my husband (petitioner), he stayed inside for 15min, then he came out and she called me in.

She swore me in, asked for my passport and the only question she made was how i meet my husband. Then she went thru my passport entries here in US.

Back in 2005 i came in US as a visa waiver (italian passport).. I had 3 months "visa" to stay the country but i stay for 6 months. (so, i overstay 3 months)..

Then, i came back 2.5years later to US, and stay for 2 weeks.. (that's when i meet my husband)

Then 5 months later i came back, and never left..

So... The officer said that she was going to approve my husband's petition (I-130), and then she stamped the application... But however, shr couldnt approve my greencard without going thru all my papperwork all over again, because at the first visit in US, i was allowed to stay for 3 months and i stayed for 6months.

She said she will call me in the next couple of days in case she need aditional documents.

So... What do you guys think? I cant believe this happen. I think is a nightmare :(

Marriage to a US citizen gives you forgiveness for overstaying. Your IO apparently does not have the seniority to approve you on the spot. Look at my interview review and you'll see that the same thing happened to me. I was approve the next day and received my welcome letter 3 working days later. All the best.

04/29/2009 - Interviewed. I- 130 approved, I-485 pending IO's review
05/05/2009 - Received NOA2. Welcome letter for Permanent Residency. I-130 and I-485 approved 04/30/2009
05/08/2009 - Touched. I-485 approval letter sent
05/11/2009 - GC received in the mail. Expires 2019
05/11/2009 - Applied to remove restrictions on my SS Card
05/18/2009 - Received unrestricted SS card

10/13/2009 - My darling husband of 2 yrs 5 months 3 weeks 3 days passed away :(

I just realized she did not asked for my EAD, as far i know, it seems that they always take it back in the interview. Maybe she was new at this position lol

Oh, i dont know what to think. Being married for almost 3 years, i thought we wasnt gonna have any problems, so, i even bought a ticket to go visit my family in 20 days. Im sooo affraid this wont happen :(

Did you re-enter on the VWP? The problem is you're not eligible for the VWP if you've overstayed, you need a visitor visa. So if you re-entered on the VWP they're probably looking into whether they can hold the fact you entered on it when you shouldn't have, against you. As far as I'm aware the onus is on them to not permit entry so you should be fine.. but sometimes their decisions make no sense so only time will tell.

In the meantime DO NOT leave. Do not leave on AP (if you have it). If you are denied while you are out you will not be permitted entry.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes.. I came back for the second time on th VWP... I was affraid they wont let me entry, but i passed imigration without any question... At the third time, same thing... They just asked where i was gonna stay, and stamped my passport...

Oh men, i dont know what to think... I did not sleept one minute last night :(

If it's even a little bit of consolation they didn't ask for or take back my EAD either. Don't travel til you get your GC in hand though
