When I filled out the I-130 I left question # 22 completely blank..

The second part states:

If your relative is not eligible for adjustment of status he or she will apply for a visa abroad at the American consular post in :

I believe I should have put Havana - Cuba

Does anyone know what the worst case scenario would be here?

Will my case sit on their shelf until the 5 month mark approaches, and be sent back to me to fill out the missing information...?? Would I have to start the whole process again? :bonk:

02-29-2012 Post Office website shows as delivered

03-01-2012 USCIS received I-130, I-485 and I-765

03-05-2012 Received 3 text and 3 email receipt notifications

03-07-2012 $1,490 poorer - both checks cashed

03-12-2012 Received NOAs for all 3 applications

Geez this happened to me also,

What they did, was sent me an I130 interview, not sure if I needed one to begin with but they did... and the officer asked me what embassy will my husband be going to? and I told her, they actually thought that he was in the country because I left that spot blank... well a couple months after that interview we receive a notice that our file was approved but however that we had to file an I-824 so that they can forward the file to NVC and so that they can correct that error, even after I told the officer, anywayyyyyy, Like if these fee's aren't big enough we had to pay $404 bucks extra, just so that they can take our file and send to the NVC, lucky that we had the extra money, ugghhhh, but we could have pulled our hair out...

I hope you don't have to go through this extra step of the I-824.

I just looked at copies of the I-130 petitions I sent for my wife and step-daughter and I left them blank too! :unsure:

This is how it is stated in the form:

"22. Complete the information below if your relative is in the United States and will apply for adjustment of status."

My relatives are not in the United States and will not apply for adjustment of status. This is why I didn't fill out this section.

It does go on to say "If your relative is not eligible for adjustment of status, he or she will apply for a visa abroad at the American consular post in:"

Now, this is just MY opinion, but I think this would apply to someone who is petitioning an IR-1/CR-1 visa for a relative who is currently living in the United States. In this case the address used in Section C question 2 would be an address in the United States. If the relative isn't eligible to adjust status while remaining in the US the petitioner needs to specify which consular post the beneficiary will apply to.

In the case of a relative that does not currently reside in the United States the consular post would be assigned based on the beneficiaries current country of residence.

I guess I will find out soon enough if I screwed up by leaving this part blank, I received my NOA1 on July 28, 2011 and should be hearing from USCIS any day now.

03/02/12 - NOA2 for both(received hardcopy on 3/8)

NVC: (37 days)

03/12/12 - NVC Received both

03/21/12 - NVC case number and IIN received for both & Emailed Choice of Agent for both

03/23/12 - AOS bill invoiced & paid for both

03/26/12 - AOS bill shows paid & AOS Packets mailed for both

03/27/12 - Choice of Agent accepted for wife (sent another for step-daughter via email and express mail)

03/28/12 - Choice of Agent accepted for step-daughter & IV bill invoiced & paid for wife

03/29/12 - IV bill shows paid for wife & IV bill invoiced & paid for step-daughter

03/30/12 - IV bill shows paid for step-daughter & IV Packets mailed for both

04/04/12 - IV Packets reviewed. Checklist issued for Divorce Decree for my wife. Step-daughter's was accepted and her case closed

04/10/12 - Divorce Decree accepted after supervisor review & wife's case closed

04/16/12 - Expedite requested for both cases due to NVC error

04/18/12 - Expedite request approved for both cases and sent to Santiago Embassy

Embassy: (15 days)

04/24/12 - Embassy received both cases from NVC

04/25/12 - Wife went to Embassy for document review. Interview date assigned for both cases.

04/26/12 - Medical Exam for both. Result - approved.

05/07/12 - Interview date for both. Result - approved!

05/09/12 - Received both Visas

05/16/12 - POE Atlanta

This has happen to me before, I called and boom!, problem solved, They told me to send a letter asking them to add the missing information on the application with all the details ( Part of the application No.,the info that should be on it, Etc) and that I did. In my case I was missing the part where I had to state the previous marriages and I had to send a letter with all the info. Make sure you send your complete info as well as the most important thing, THE USCIS RECEIPT NUMBER you received when the acknowledge your petition.

If you want to make sure you can always call USCIS and ask, but I'm sure you will be fine by sending the info in a letter with all the details like I did and my daughter's case worked just fine.

Hi,

I am Vinny and I am newbie here. I just got confirmation on the delivery of my I 130 for spousal CR1, but now I realized I left the notorious question 22 on i 130 blank!

I am not sure what will happen on this.. Will I get an RFE? In my case, my spouse is in India where we have two consulates issue CR1 visas.

What should I do to correct this data?

You likely won't get an rfe for that question. A lot of people get it wrong and a lot don't answer it (or answer it correctly.) I wouldn't worry about it.
