Hi,

My faience and I went to the interview today at the Delhi Embassy. At the first window they took the fingerprints, second window they told us that we have to pay the visa fee, so we went to the 3rd window and the guy at the window told us that the draft ($$) is not enough. So we had to leave the building to find the ATM machine and came back to pay the fee. Then most of the windows were closed and we sat there for a long time. Finally we were called again and the lady at the window interviewed us. I am a US citizen and my fiance is Indian citizen. She only asked 2 or 3 questions to my fiance and all the questions to me. I am a U.S. citizen and I was surprised as to why they would interview me. They finally gave me back the passport and the form of 221 (g). They asked in 221 g form; because he has no name on his birth certificate and they never took our medical records and returned the passport. They told us that we have to submit the birth certificate affidavit form and the passport at VFS office. Our case will expire on the 28th of Feb. this month and we are scared and disappointed.

What is this. Is this a denial for the visa? Please help us. Thank you.

my visa was supposed to expire in like September of last year and my fiancee just got our visa the 6th of feb and we were fine after we called them and asked for an extended time just call and ask for them to extend the expiration date as long as your getting all the papers to them as fast as possible its usually them that make it last so long so they should just have the expiration date changed or something

The consular officer has the ability to extend the expiration date. It is at their discretion. For a simple paperwork issue like this, the date is usually extended.

Because you had missing vital information [the birth certificate] they can not at this time process the visa. The good news is that this should be easy to fix! Once you have the affidavit fixed, drop what is asked on the 221(g) at VFS. It appears the usual turn around time is a few weeks to get the visa once that occurs.

He was given a "soft" denial for something that you CAN fix. They will be able to give him the visa after they get the birth affidavit. As long as the birth certificate is the only issue, they will not need him to go back to the consulate. They will just confirm the affidavit, print the visa, and send his passport back via bluedart.

Hey VJ's please help. I just want to know what are the chances of me getting the visa ?

221(g) doesn't mean that you are refused. when they need additional documents, they give 221(g) which states there what additional documents are needed and i don't think that you need to worry about your petition validity. you don't need to extend it. As far as beneficiary submit documents( DS156. DS156k etc ) to the embassy within that validity period you are fine. i submit my documents one week before the expiration date of my petition. My interview was on 23rd jan. CO asked me petitioner's statement of intent to marry which i didn't have so he gave me 221(g) and told me to submit that statement and passport. Note that my petition was already expired. i submit those two docs a week later. Since i am Pakistani national so i was worried about this additional processing thing so i called DOS ( department of state) on 9th feb to find out the latest update of my case and they told me that i am approved.

In you case i would suggest to submit everything they have listed in 221(g) form n then a week later call DOS to find out about your case and i don't think you are refused cos they just asked you docs to submit so that they can issue your fiancee a visa.

DOS number is +1 202 663 1225 then select option 1 and then 0. you will directed to visa officer they will ask you her case number

you're welcome. Btw you have mentioned in your profile under interview result that you are in administrator review how do you know that? did they tell you?

The CO gave me 221g for birth certificate of affidavit and I think its AP.

no it doesn't mean that you are in AP most of the time they tell during the interview . You should see AP option in 221g form if its not selected then you are not at the moment. Just submit every they listed in 221g asap.
