I'm hoping someone can help me. Yesterday I received an RFE in the mail. The RFE says it's for my Marriage Termination. It says they acknowledge I submitted a copy of my divorce decree. It says it's not acceptable because the judge did not sign it. The issue is, the judge did sign it. He did not sign it on the second page where there is a line for his signature. He signed it on the top of the first page. I called USCIS and the woman I spoke to suggested that I try and get the judge to sign it "where he's supposed to". She said if I cannot then to resend the decree along with an explanation. I called the court today and the woman I spoke with said that my attorney electronically submitted his documentation and that the judge's signature at the top and the stamp is how all electronically submitted paperwork is handled. I personally went to the clerk of the court today and asked if the judge could sign the document on the signature line. The clerk told me he would look into it. I will go back there tomorrow. I am not confident I can get a new signature from the judge. I will also ask if someone from the court could write an explanation for me. If I cannot get either from the court should I just resend with a written explanation? Has anyone else had this issue?

Thanks in advance to any advice you may be able to give me.

Try contacting the state board of health/vital statistics in your locale and obtain a certified divorce decree from them.

HTH,

Good luck

Thanks for replying so fast. I will try and contact them but I am certain that what I sent to the USCIS is certified. It has the official stamp on the top of the page right next to the judge's signature. It is the official document that I received from my attorney.

1. See if the judge will sign it for you.

2. If not, ask the clerk or judge to write an explanation (that electronically submitted documents are handled in this manner) for you, for immigration purposes (show them RFE doc). Any documentation from the court, addressing this might suffice.

3. When you send it to USCIS attach it to the RFE along with your own explanation as well.

Worst case scenario, they don't give you a letter or sign, just write your own letter explaining the dates you visited the courts and what was told to you and by whom (and that is what you send USCIS with RFE).

Thanks for the response. I will make certain I write out the steps I have taken to address the RFE.
