I-130 bonafide marriage

what if i did not send any Evidence of a Bonifide Marriage with my I-130 to USCIS??

would that be a problem? or will i get a RFE?

my case is currently in Initial Review at uscis csc

i am already married and filed for a CR-1 Visa

i do not have anything that they list!

my spouse lives about 6 hours away from me so i visit her

like 2 times a month! (Driving)

all i have is marriage certificate from Mexico

and pictures. i have phone records from text messages

but not from call logs as we use Nextel to talk because

its so much cheaper

what to do?

RFE is very possible ( just pray and hope that no RFE)...because evidence of a bona fide marriage is a must for the petition but you can always send them the documents that they needed, of course it is another delay.

What you had now is good...you can add receipts of restaurant, gas (only my idea)...

we don't have call logs either...TRy to give them photos of both of you with her or his family and friends...

I agree with amerisian. Think outside the box. Usually, one piece of evidence isn't compelling by itself, but coupled with other pieces it makes a solid one. For example, text message print outs, coupled with some pictures, restaurant bills from his hometown, gas receipts and maybe passport stamps would make an excellent case. If you have pictures, adding some from different occasions and different seasons is great evidence, especially if some are pictures with family members.

that's its fine. That is all that is required since we cant not do much!?

and text message print outs would be like my billing print

showing that i texted her number right? it doesnt have to show

the actual message correct?

Correct. We just sent a phone bill print and highlighted calls and texts. Just the bill printouts and records. You don't need the actual texts. Something is better than nothing. just remember, multiple small, seemingly ample pieces of evidence they can together be strong.

I also drive to Mexico to see my fiance. I could suggest pumping gas at the border and pay with a credit card so the receipt shows your name. I also exchange money at the border and keep the receipts. Keep receipts from super markets, restaurants,etc... anything you do in Mexico. Take lots of pictures in Mexico. I agree with the other members showing different occassions.

If your spouse has a bank account in Mexico, see if you can be added to the account.

Since you said you married in Mexico, can you tell me what requirements you (as the U.S. citizen) had to do to get married there? I will be getting married in Tijuana next month and i am having the hardest time trying to get the proper requirements. I get different versions of them.

Since you said you married in Mexico, can you tell me what requirements you (as the U.S. citizen) had to do to get married there? I will be getting married in Tijuana next month and i am having the hardest time trying to get the proper requirements. I get different versions of them.

alright thanks for the advice.

and to get married was a BIG hassle!

1) i had to get my birth certificate apostille at the Secretary of State's Office in Los Angeles (its a gold stamp they on stating that its a real birth certificate)

2) i had to get a "No Record" of marriage at the same place i got the copy of my birth certificate.(just states that you haven't been married)

3)i had to get all my documents translated in Spanish (birth certificate,"No Record" of marriage, and ID card)

4)(this was the hardest step)i had to go to "secretaria de gobernacion" in mexico and fill out a form stating that i want to marry in mexico. they take a copy of your passport and they also get the information of the person who you will be getting married to. along with some passport style photos of the both of us. you have to pay a fee also i think it was like $180.00 cant remember might be more. and the important part of this is that you have to wait like 3 weeks to get ur case complete and they give you a paper that says you can now get married with the person you stated.

5)you can now go to the office and get married and dont forget you will also need 4 witness

it was a lot of work but in the end payed off.

When filing the I-130 the list of required stuff are:

Payment as required by USCIS. Use a personal check if allowed by the Service Center (as of 4/2005 they do allow this). If not, use a money order so you can track the payment.

2. Cover Letter. Should include a description of what your are petitioning for (I-130), a table of contents (list everything in the packet). If you need additional room to explain your case, attach a separate sheet (list the attachment on the cover sheet). Make sure to sign and date the cover sheet.

3. Form I-130: Petition for Alien Relative

4. Copy of the full Birth certificate (front and back) for the US Citizen or a copy of ALL pages of the US Citizen's passport. This is used to establish citizenship.

5. A copy of petitioner's proof of naturalization. (If applicable)

6. A copy of petitioner's proof of permanent residency. (If applicable)

7. A copy of the intending immigrant's birth certificate and/or passport along with English translation. (If in any language other than English) (no longer needed)

8. A copy of your marriage certificate (If not inEnglish then again get a translation)

9. If either you or your spouse were previously married, submit copies of documents showing that all prior marriages were legally terminated (court certified copies of the petitioner's and/or intending immigrant's divorce documents).

10. A copy of a prior spouse's death certificate. (If one or both of you were married before, and the prior spouse died)

11. G-325A filled out by the US Citizen, signed and dated.

12. One passport-type photo (see specification) of the petitioner. Write the full name on the back. Place in a plastic bag and label the bag "Photo of <Insert Name>". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

13. G-325A filled out by the non-US Citzen spouse signed and dated.

14. One passport-type photo (see specification) of the non-US Citzen spouse. Write the full name of the beneficiary on the back. Place in a plastic bag and label the bag "Photo of (insert name) ". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

We didn't have the stuff the listed either. We got affidavits fom friends. Also, I sent in beneficiary forms from retirement accounts showing my husband as my new beneficiary. They seem to like financial ties that you can show. Good luck!!
