Hi,

I am a divorced conditional permanent resident and my GC expires on July 29th. I am planning to go abroad for a while and to come back to the US before starting working on Aug. 1st at my new job. June 1st - July 26th (before my GC expires) are the dates of my trip. Once I come back to the US I will have a new address, since I will be moving to to a new city.

I plan to file early April once all the documents are collected with the help of my immigration lawyer and then to have a walk-in biometrics. But if during the time I am not in the country I receive an appointment, what should I do? Is there a way to deal with that? Also, after I file for th ewaiver, will my GC be automatically extended for one year?

Since you are already divorced, you need to file I-751 with a waiver right now, not in April. If (or when) USCIS finds out about your divorce, they will be compelled to terminate your LPR status and then to start deportation procedure against you.

Once you file I-751, you will receive a receipt that will extend your LPR status for a year and protect your status until decision on your petition is made.

If you receive an interview notice while out of country, you will either have to return and attend the interview or you can try to reschedule.

Better question is - What will you do if you get denied while out of the country? Once denied, you will not be able to enter the US to sort it out.
