The government doesn't have to assist gay couples in marrying any more than it assists hetero couples to marry. Nobody is asking for any such thing. The issue is that the government prevents gay couples from marrying. Not that you'd be able to notice. You do live in an alternate reality after all.

Do I have a right to walk through airport security with a gun? The sky marshal is allowed to. He's a man. I'm a man. I should be able to do that too. After all it's the government who said he can and I can't. Therefore my "right" to do so is being violated. After all, at least my gun rights are in the constitution. The last time I checked me or anyone else being married isn't.

Ted Olson is a very accomplished lawyer who has an impressive record on the cases he advocated before the Supreme Court. He knows that the Constitution is the key to marriage equality. I've read the article.

You can spin things left, right, and around in circles, but there is NOTHING constitutional about marriage and the Federal government doesn't recognize marriage outside of the IRS as I've mentioned.

Marriage is a contractual agreement run by the state and requirements vary state to state at that. It's not a federal matter and nor should it be. Any argument in cases like these should begin and end at the State supreme court as marriage is not recognized in federal law. Until it is, any act by the Scotus, no matter which way it rules, is judicial activism.

You've got to remember, I'm not arguing against homosexual marriage. I don't care either way. I'm simply looking at this from a lawful perspective. We are a country of individual states with their own laws, and as long as those laws don't interfere with federal matters, there's not much the courts can LEGALLY do about it.

No.

It should enforce the contract of marriage the same as any other contract, and the requirements to enter into that contract would be the same as any other contract...over 18 years of age.

we do not need the government to tell su what "marriage" is, we only need them to enforce the agreements adults make, just like other contracts. They do this, of course, with fees paid by the users.
