California won't appeal the decision.California isn't even a party in the case. That has been the thorn is the side of Prop 8 proponents. They passed a law that the California government doesn't support, including the state attorney general. One of the problems that the proponents have, is that they lack standing, if California doesn't want to defend its own laws. SCOTUS may decide otherwise if the proponents have the means to take it that far, but as far as California itself, the executive doesn't have a dog in this fight, or so they have decided.

The majority of voters who actually cared to cast a vote may have been. That's a far cry from the majority of Californians. Throw in the demagoguery that's going into a wedge issue like this and you actually have a small minority - the California based American Taliban - having scored a victory at the ballot box. It's also important to remember that the attitude towards same sex marriage has changed since this ballot initiative passed. It's been last year that the tide turned in favor of same sex marriage in this country. As a nation, we're slow to embrace the 21st century but even Americans will eventually get there. The American Taliban will lose and human rights and liberty will win.

You have the liberty to be with and live with whomever you want.

The problem as I've said time and time again is that government is involved in marriage to begin with. As I've said as well, other than the IRS, the federal government has ZERO influence or right to say anything about marriage as there are no marriage laws, no constitutional laws, etc. on the books that deem them necessary. Outside of judicial activism (courts cannot write laws, sorry) marriage doesn't exist at all on the federal level, nor should it. It shouldn't even exist on the state level, but that's a different argument entirely.

Here's the truth.

If you are in the hospital - you should be able to appoint whomever you want to be by your side and make decisions for you if necessary. It shouldn't have to be a spouse or a parent. If you want your best friend's uncle to represent you, then by goodness you should be able to have that.

Don't get me wrong, I get the argument that the homosexuals are trying to make, but it's an argument they shouldn't have to make because we have government far too involved in our lives of whom we choose to be with. It's none of the government's damn business. As long as we choose to keep making it the government's business then there are always going to be "discriminatory" situations because that's how the world works when you rely on other human beings to be a deciding factor in your life.

I think the reason for goverment to be involved in marriage in the first place would be for inheritance

and assigning responisbility for kids. We have DNA for the responsibility thing now.

There is no need for government in any of that. We do not need government involvement in marriage AT ALL. Take care of your own inheritance or let your heirs do it, not the government's business. Child support and responsibility is there whether married or not, not an issue related to marriage.

The only "law" we need related to marriage os that you be able to enter into legal binding contracts, age 18. Any further limits are not necessary.

End income tax and implement the FAIR TAX and you not only give the government a solid source of funds that cannot be tampered with by politicians, but you eliminate any concern for joint tax returns, tax deductions, inheritance tax and most of the other fabricated reasons for government involvement in marriage.
