I'm just saying, when you automatically know what a court's ruling will be and the extreme likelihood that its ruling will be overturned, then perhaps the court should change the way it acts/thinks.

California won't appeal the decision.California isn't even a party in the case. That has been the thorn is the side of Prop 8 proponents. They passed a law that the California government doesn't support, including the state attorney general. One of the problems that the proponents have, is that they lack standing, if California doesn't want to defend its own laws. SCOTUS may decide otherwise if the proponents have the means to take it that far, but as far as California itself, the executive doesn't have a dog in this fight, or so they have decided.
