Hello All,

I will do my best not overwhelm you or get too far ahead of myself.

First I am in the process of filling out and filing the I 1-30. I am currently in Kathmandu with my husband and plan to send/apply from here. First there is no DCF in Nepal, therefore I want to clarify that I will be sending all of the documents to the Chicago Lockbox. Correct?

Also is it possible to pay via credit card for the $420 fee? I recently ran out of checks and am not heading back to the states for a while.

All of the documents will be sent to my parents house, which is also my permanent place of residence when I am in the United States as there is no real reliable postal system in Nepal.

Regarding the I 1-30 form section C question number 17, it states that one must list husband/wife (me) and children of your relative. My partner has a child from a relationship five years ago. They were never married and the child/mother are both US citizens, living in the US. I have read other forms that debate whether or not to put children from previous relationships. As I am not petitioning for that child would it be necessary to list her? Also once I start or don't start listing consistency is key, so I ask you opinions please! What would you do?

Jumping ahead do you believe it would/will be possible to complete the whole process while both of us are still living abroad? That is all for now, but I will be back shortly I am sure with a difficult yet obvious questions.

You must list his child from the previous relationship. Failure to do so can be considered Material Misrepresentation. Anyone who suggests not listing the child is giving bad advice that could result in trouble for you and your husband.

Hi Ryan,

Thank you for your replies. I suppose than I shall fedx the materials to my parents house and have them make a money order. Beside that I do not believe there are very many other options.

More questions for all:

I shall list the child on the I 1-30. During the interview process do you foresee them asking questions about the child besides acknowledging her? There is no relationship my husband, myself, the baby mama and child (yes very unfortunate but reality).

Also when the 1-130 is received and they will send me the NOA number by mail? is it possible to have it sent electronically or have access to it electronically? Is that even necessary?

Submit a G-1145 with your package, submission of that form will send you a notification of acceptance electronically. After the file has been accepted, you can sign up for an account on the USCIS website to receive electronic notifications with regards to your file.

Hey. It sounds like we are going through similar paths here. I am also living in Kathmandu with my husband and filing for the I-130. I ended up mailing it from the states while I was visiting this past month. It took a good bit of time to put everything together but we finally mailed it out and got our first NOA. Write me if you have any questions about it or maybe we could meet up sometime. We have a little daughter too and are waiting this year for all the paperwork to go through. Hope it's going well for you guys.

Hi there,

When are you planning to return to the US to live? I also live abroad in a country that does not have a reliable post, but I STILL used my address abroad on the I-130. The reason for that is because it is becoming evident that the USCIS is fast tracking petitions for those abroad. So if you are under a time crunch, I suggest you still use your Nepal address.

I used a continuation sheet, placed behind the I-130, that describes the issues related to my address abroad, and supplied them with a Fedex account number to use. I just received my NOA1 via email, so I have yet to know if they will send the documents to me this way. However, The Tier 2 Service office at the USCIS told me that they would try to honor that request, but couldn't promise.

There are lots of other things to consider in this process when you are returning from abroad - ie you will have to prove that you will an income in the US, or a joint sponsor...I suggest taking your time to make yourself as knowledgeable as possible about the process BEFORE sending in your forms. I started reading the message boards and guides here about 2 months before I submitted my packet, and I am still learning about ways I could have improved my packet. A little bit of investment to start the process right seems to go a long way.
