Hi,

We married last year in USA, and we filed for AOS,our I-130 is approved and I-485 is in Security clearance.

Now the tax year season, I want to file tax, but my wife don't want to file jointly with me as she owe a lot to IRS, and she also gets SSI for her son who down syndrome.(From her previous BF)If she file with me then IRS takes everything and she couldn't get SSI for her son.

I don't want to file with her in this situation. Before marriage I didn't know about how much she owe to IRS.

I Checked with a Attorney and he said I can file my tax as 'Married filling seperately', but I am worried when I apply to remove conditional on my 2 year GC it might be affected.

If any body come across this situation please help me & give me some suggetions.

Thanks,
