Your letter should state what exactly is required from you. and not give room for assumption or "looks like" as you put it.

I agree with dblade, From what I know you can't use your immigrant spouse income and if you have to use a co-sponsor, they must be PR or USC. Please do your research well & make sure you turn in the required & appropriate response. You have 87 days so take your time cos a wrong/inadequate response might lead to denial.

On the marriage cert, How can they possible miss out the 2 copies,1 in I-130 & 1in I-485 that you included.. Guess someone is too lazy to look it through your file.

but hey! Who are you to query USCIS on that. just send another copy. except they asked for original which I doubt

Early Biometric has not been proved to speed things up. However late biometric(I mean after appointment date) can slow things down. So relax the longest wait is usually between biometric and EAD approval/interview letter

Just didn't know since I was using the intending immigrants' income I needed to include FORM I-864A as well. If the intending immigrant is AUTHORIZED to work in the US, yes you can his/her income if it continues from the same source after AOS, doesn't have to be a PR or USC.

Of course I'm sending another copy in, just wondering if anyone out there has had that problem...anyways sent it in again. Wishing you all the best :innocent:

Yeah actually I called USCIS and spoke to a live person because the letter did not fully explain the issue they were looking for. "Looks like" is just a phrase of words I use. The live customer rep said I can use the intending immigrant's income per instructions I already thoroughly read on form I-864. Just didn't know since I was using the intending immigrants' income I needed to include FORM I-864A as well. If the intending immigrant is AUTHORIZED to work in the US, yes you can his/her income if it continues from the same source after AOS, doesn't have to be a PR or USC.

Cool,I'm glad you got it covered. Thanks for clearing that up for me too.

I think most people are just a bit hesitant about using intending immigrant's income/assets if such are outside the US as they are hard to verify.

A quick search on VJ will show RFE's have been issued for Marriage cert for previous AOSers too, so it's not uncommon

We received a Biometrics notice today!:) Unfortunately, my wife has been scheduled one day after giving birth to my son. Definitely trying walkin on Monday. I'm pretty sure they'll let her do it; they let me and I don't have a big belly. If not, I guess we'll have to induce labor earlier. :lol:

I wouldn't worry Jay. The 9th was a Friday, it has only been 5 business days-- I would expect to wait at least 7-10 business days before receiving anything from the USCIS. It will get to you :thumbs:

Thank you! I just want to know what might be the reason..(I think I know to be honest) We're using a lawyer so I know we sent all the mandatory documents. The ONLY problem was my husband's 2010 taxes(he didn't file last year :bonk: but we did 2010 and 11 already so we are fine now)we sent 07/08/09 and all w2's including 2010..but I think they want the actual taxes. :unsure:
