Greencard for a gay partner???

I know of a quasi-similar case. The American adopted the immigrant as his son and got him here that way.

How could that even work?

There is an age cut-of for adoption or immigration purposes not to mention I can't think of any state (even in the deep south) that allows someone to marry their legal son.

IT is really heartbreaking.... Gay people love as hetero people and I personally think they should have the same rights....

This is really sad..... really sad... at least for hetero couple, no matter what, there is a light at the end of the tunnel, not for them.... Sad sad sad!!!

I have a friend who is in a relationship with a guy from Australia and like you, it makes me so sad that as the law stands right now they could not marry and adjust his boyfriends status. They have been together a long time. Right now his boyfriend is here with a student visa and they are hoping once he is finished with college that he will be able to get approved for a work visa. It tears me up inside because I imagine how I would feel if me and my husband were a same-sex couple and had the same uncertain future. I hope your friends are able to figure out something so that they can be together. Of course my bigger hope is that the US repeals DOMA and allows same-sex couples the same rights as straight couples. Love is Love.

Australia does recognise gay partnerships. there is always a solution if you look for it.

No idea how they did it, it was years ago. The immigrant is from Columbia. He was brought in as a son for paperwork only, they never married, just lived together.

This opens a can of worms for immigration fraud, anyone can claim they are partners and file for immigration.

Would be very difficult for immigration to validate the relation is real, other countries will also have to issue a same sex marriage certificate, which means all the countries around world will have to recognize same sex marriage.

There isn't an age limit on adoption.... (at least in Florida anyway)

Australia does recognise gay partnerships. there is always a solution if you look for it.

Unfortunately my friend makes his living off of the TV industry here in California. His boyfriend is also in school looking to work in the entertainment industry (SFX), so while they could relocate to Aus, it would be their last resort as they'd both be giving up their current/future careers, but yes they do have that option at least which is more than the OPs friends.

Who is an Adopted Child Under the Immediate Relative Process?

Under this process, an adopted child is considered, for immigration purposes, to be the child (or adult son or daughter) of the adopting parent if:

  • The parent adopted the child before his or her 16th birthday (or before the 18th birthday under certain circumstances as described below). You submit evidence of a full and final adoption
    AND
  • The parent had legal and physical custody of the child for at least two years while the child was a minor
    • The legal custody must have been the result of a formal grant of custody from a court or other governmental entity
    • The custody and residence requirement may be met by custody and residence that preceded the adoption
    • The two years custody and residence requirements are waived for certain abused children


A child is still considered to be an adopted child if they were adopted after his or her 16th birthday but before his or her 18th birthday, and:

  • The child is the birth sibling of another child who was adopted by the same parent(s) before the other child's 16th birthday and immigrated through the Immediate Relative Process
    OR
  • The child is the birth sibling of another child who was adopted by the same parent(s) before the other child's 16th birthday and who immigrated as an orphan based on an adoption by the same parent(s)

If his partner is or becomes a transsexual, he may be able to immigrate as a fiancee, provided he lives in a state where the marriage would be recognized as a heterosexual one.

The alien partner would have to live in a country that would issue them a new birth certificate which recognizes the gender reassignment. Then legally the alien would be female.

As they termed it a gay relationship I doubt one is transgender as they don't consider themselves gay or lesbian but rather a man in a woman's body or the other way around so the relationship wouldn't be gay...

A few months back I read an article where two women were in a partnership and got married once NY legalized the marriage and now the non-USC got the permanent green card it was in the New York Post. You can research it maybe it can help.

This opens a can of worms for immigration fraud, anyone can claim they are partners and file for immigration.

Would be very difficult for immigration to validate the relation is real, other countries will also have to issue a same sex marriage certificate, which means all the countries around world will have to recognize same sex marriage.

I don't see how it's different from hetero couples. They would still have to prove the validity of their relationship just like hetero couples.
