Non-refundable contracts are not bulletproof.

If the party receiving payment fails to fulfill their side of the deal then you can sue them for the fees to be refunded.

How do you prove they didn't do their job? Simple actually...

File the I-129f per the guides here (not including all of the extra ####### the Lawyer is asking for). FWIW, as simple "Letter of Intent" is all that's really needed to prove intent to marry.

Once you have your NOA-2 in hand you've proved that he didn't do the job you hired him for.

You can give the lawyer 2 options, issue your refund or file a complaint with the Bar and sue them for the fees.

Stop this lawyer BS, follow the above advice to a "T".

This lawyer is likely setting you up so you will quit and he doesn't have to do anything.

When dealing with bureacracy you send what is asked nothing more nothing less, and what he is asking is not required.

People! Never use a lawyer for a vanilla K1. It cost more, invariably introduces more waiting time and possibly errors.

Follow the guides here, pay attention to detail and Viola'! Cheaper and faster.

that is horrible I put my F-129 together by myself in a week, with not RFE's and a quick Noa2

Mar 2011 - After 5mths denied for lost docs - Attempts to follow up failed. Mar 18 2012 - I-129F sent - No sign of NOA1 but they have banked the check...Jul 24 - Update - USCIS has located our file
Infopass Apt - they sorted through everything - our 2011 and 2012 file keep getting mixed up - getting us a Case# (still waiting) Dec- Infopass Appt- expecting to get a case # in about a week ..Still no Case number

Mar 2013 Infopass - advised file was in a box somewhere,and it would be quicker for us to refile. Life gets in the way... New petition submitted July 2014 .

Your so right ! I put ours together while deployed to Afghanistan, living on a remote observation post in the mountains ! We did have some weak internet but i was able to fill out all the forms online and save to a thumb drive, Then on a resupply mission i printed it all out,including pictures, and mailed it! Too easy ! I did get an RFE because i couldnt get a court document i needed, but my wife is here now beside me watching me type this!.lol

@Bob 4 Ana: Thanks for the advice, I'm really getting frustrated at the lawyer but my fiance thinks we should be nice to them since he feels he could screw us up even further by delaying the start of the process even more.

@Everybody: Sorry seems like everytime I post here, all I do is rant xD. I do hope people reading VJ would realize DIY is better than MLDI(Make Lawyer do it). I have requested for the secretary to forward the documents that we sent them to USCIS.

If you fire the lawyer and file the petition yourself then there is no way the Lawyer can delay the process ANY LONGER THAN THEY ALREADY HAVE...

Gosh. I feel bad for you. Like 99% here, we did our own paperwork. It only required about 10 hours of document gathering - photocopying. The only difficult part is figuring out what to do, but if you read this site all the info is there. I'd move on him to be disbarred. Heck, hire another lawyer and sue him lol
