he has a ssn number though. that was not an issue. i dont know why he did that.

Technically, you can't add a dependent or wife that's not in US for more than 6 months.. I think this is the reason why your tax preparer didnt file you both as married jointly but... you need to file a Married filing separately and NOT SINGLE.

The other thing to is.. if your wife did work a little, she can file maybe part year resident her state tax return..

I married on 2011. i went to file my taxes last week and told the man that i got married but hes not working so i want to file "married filing jointly". he told me that i cannot do that since my husband isnt a us citizen. i told him that he is a legal alien with a ssn (k-1). he said it is not possible to claim him as a husband and that i must file single. he seemed to know what he was talking about so i listened to him and filed single. my refund is ok but ive been told the refund is better when you file married jointly considerimg he doesnt have a job yet. i dont want the irs on my back, what do i do? can i fix this when he gets his ead? a bigger refund is needed considering we are having our wedding ceremony soon and we also need to buy a car. his -94 is expired, it expired feb 4 so now were waiting on the aos. please someone advise me. thanks.

OMG.I would be mad at that person... I would Change it He lied to you.. . I would call the IRS.. and tell them.. your husband will need to apply for a pin number through the IRS.. website and thats how you file with him..It will take awhile to get the number but you don't wanna lie about things like that. because you going to have to turn in your tax returns when you do your husband papers for the last three years..and you cant have that you married in 2011 and have single on 2011 tax returns....

I filed jointly and we were married only a month of 2011 get some advice from another tax person or turbo tax or whatever that guys head is in the clouds :bonk:

H&R Block is full of poorly trained workers. California only requires 60 hours of training before a person can be certified as a tax preparer. Anyone with a high school education can become an H&R tax preparer. Compare that to an accountant who goes through 4 years of college and is certified by a board of accountancy to practice.

After having known people who got employed by H&R Block for the tax season I have made a mental note never to use them. Their minimum standard for hiring temporary employees is ridiculously low. As most people have simple taxes, and are frightened by forms and instruction this is not really a big issue for most of their customers. But I bet most people on this forum doesn't fall into this category and thus need slightly more than the average american can provide. As always, it is best to read the instructions yourself and then decide to either do it yourself or let someone prepare the forms for you such that you can check their work. Never trust outsourced labor.

You are dealing with two separate, yet connected issues:

1) you submitted a false tax return to the IRS. If you can choose who not to have as an enemy, it would be 3-finger Joe, the KKK, and the IRS. None of these like to be bullsh*tted.

In fact, filing single when you were in fact married in all likelyhood has cost you money, which is where the interconnection comes into play.

2) since the only reason for somebody to pay more than necessary to Uncle Sam and file a false tax return is that the relationship is not genuine, USCIS may conclude just that.

In your case this is most likely not a pressing issue, but know that couples who file for Removal of Conditions, which you will have to do in 2 years as well, and can't show that they at least filed their taxes as "married," are in real trouble. Joint taxes, finances, and living together are the 3 pillars of RoC.

Sure you can. No need for them to live here for 6 months first. I got married in Dec. 2010 and filed taxes as married filing jointly for 2010. My husband had only lived in the US since the end of Oct. 2010. http://www.irs.gov/businesses/small/international/article/0,,id=96370,00.html <-- and THIS is how the OP should file. They will need those joint taxes for ROC in the future too.
