Yes do this. Speak to his supervisor 'cause he's obviously a moron. i married Nov 2009 and filed taxes for 2009 married joint with my husband for that years taxes. It was totally fine. H&R Block did mine as well.

If your husband or wife has a SS# and you are married then you can file married...............End of story.

When you file your amended return, you need to submit it with a completed W-7 form and a letter from your spouse indicating that they want to be treated as a resident alien for 2010 for tax purposes. When you submit the amended return it will go to Austin Texas and they will assign your spouse a ITN (Individual Taxpayer Identification #) and until your spouse gets here that will be the number you use for them.

11-22-09 Went back to the States

1-1-10 Talked to her father on the phone queried about my intentions. Told him I intended to marry her.

10-16-10 Meet her parents and family in the province for the first time

10-25-10 Returned to States

11-2010 Started her annulment process

1-4-11 Free to marry within the country

2-8-11 3rd trip to Philippines

2-10-11 Annulment process complete (can file for US visas now)

4-27-11 Got Married

5-30-11 Finally received marriage contract from priest

6-4-11 Discovered we needed to get an electronic endorsement of our marriage contract submitted

6-22-11 Finally got updated CENOMAR to show annulment of previous marriage

7-29-11 Finally had to say good bye and leave the Philippines after 6 months

8-18-11 Submitted CR-1 pkg to visa service agency

9-9-11 After a thorough review and obtaining additional docs, finally mailed our pkg to USCIS.

9-12-11 NOA1 received

3-14-12 USCIS approved our I-130

3-17-12 NOA2 received

NVC:

3-19-12 Package acknowledged by NVC.

4-3-12 NVC enters our package into their system and generates our case#

4-4-12 AOS pmt made

Manila Embassy

4-9-12 Petition US Embassy Manila to expedite since I will be in country

5-23-12 Interview at US Embassy - approved

5-31-12 Visa in Hand

6-6-12 Len Arrives!!!!! in the US via Chicago to Houston

Wrong. The OP's husband has a SSN (as stated in the OP), no ITIN is required.

I'm a K-1 visa holder and my husband and I fill the taxes form jointly since I don't have a legal US number like SS or Green card since I'm doing the adjustment status, we add our marriage certificate copy and I filled the form w-7 which is and ID TAX NUMBER FOR YOUR HUSBAND while he gets all his paperwork in order... hope this helps! just attach a certified copy os his passport to the taxes too.

You shouldn't have filed as single. You don't meet the legal definition. (Please lets not argue about this for those who think it is okay for a married person who is not legally separated to file as single.)

A spouse is not a dependent. A spouse is a co-filer - that's why it's called married filing JOINTLY.

I called H&R Block.

There "expert" suggested that I file single and then amend the return once my spouse gets her SSN or ITIN. My wife is a non-resident alien living in South Korea until we get our visa.

I filed with the married joint status w/ the IRS, paper file. Here is what I did. I sent my 2011 W-2, tax return and W-7 to the Texas (Austin) office of the IRS (as suggested on the W-7.

I included

1. Certified copy of my wife's Passport (bio info) as directed on the W-7.

2. W-7 form from IRS (completed).

3. W-2.

4. Tax Return.

I did this on 11 January 2012. I have a message on the IRS website "where's my refund" says I will get the full amount in two days.

Also I called the IRS and requested information on how to do this, the above is what the IRS told me to do and how to file.
