Should my wife sign her AOS forms with her maiden name or married name as all the documents have her married name on them?

We just filled out all the AOS paperwork and used my wife's married name that the county clerk's office used for the record. Our original petition, of course, was in her maiden name.

You misunderstood, there is nowhere to put married name on the marriage application form in Florida and the gentleman at the court house said we would have to change everything at each institution after we were married. You are correct she hasnt changed her name with SSA because they said she needs her green card or EAD before they can do it. Oh well were filing everything for AOS with the married name well see what happens i guess.

Same in Texas. Just our names before the marriage. We did alot of discussuion with the county clerk on how it could filed.

We had the I485 her maiden name and on the AOS stuff and we changed it at the IO interview to her married name, if you have not submitted submit as you want it. FYI- the IO did say they do not like hyphenated names. Once the green card was received we changed the Social, DL etc. Have fun.

USCIS is a federal institution and will recognize a marriage cert as an appropriate name change document. Some states will do it "automatically" for you, by designating a space for "name before marriage" and "name after marriage," but not all states do that.

USCIS is a federal institution and will recognize a marriage cert as an appropriate name change document. Some states will do it "automatically" for you, by designating a space for "name before marriage" and "name after marriage," but not all states do that.

I'm in the same situation and the same questions!!! where did you find the A#? In the I-797 NOA???

Ho is she signing at the end of all forms? with her new married Signature? or her maiden Signature?

The A# is located on the NOA 2 in the top right corner, i guess this made for a good discussion and hopefully will help other. :thumbs:

Yep, in FL you have to go change everything by showing your marriage certificate. Fill out the AOS forms with her married name so her EAD and green card come with the legal name she plans on using from now on. Use it to show SSA to change her name, although they should change it just by showing the marriage certificate to them.

My husband is Latino and of course has two last names, and that is how his name was written on our marriage certificate. Therefore, the DMV made me take BOTH his last names instead of just his first family name that I was planning on using. They would not give me a new drivers license in my married name any other way. They said it had to match exactly with my SSN and his name on the marriage certificate, so I ended up having to change my name with the SSA twice and got one extra last name I was not planning on using. Might want to keep that in mind when deciding on how her married name should read. FL is kind of a pain for changing your name.

Take your marriage certificate to SS, DMV, where ever and the certificate will be sufficient to change her name. Some places may want to see the abstract so make sure you obtain a copy. This would be the approach if she wants her married name on identification. Make sure she uses her married name on all forms of AOS. I failed to do this and had them hyphen my married name at my biometric appt. It cost $400+ to change it later if she uses her maiden name.
