Should my wife sign her AOS forms with her maiden name or married name as all the documents have her married name on them?

Does she want to change her name or not? If all her docs have a new name on them, then I assume she wants to change her name. She should sign documents in her current name.

If she wants her married name on the green card then she needs to use her married name for all of the paperwork. If she wants to keep her maiden name then she needs to use her maiden name on all of the forms.

Yes, married name when the AOS and all other papers are in the married name. I signed everything in married name from the day after changing it with SSA, and all papers to USCIS(and when having called them) are in married name.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

Use the name she decided to use on her marriage certificate. Based on what you have written, I am assuming that it is her married name. All the best.

The marriage certificate is her legal proof of name change, if she ha decided to use your name as her married name(and signed her married name), then that is the name she should use from now on, including AOS. There is one space in the forms where they ask for "name as it appears on the I-94", that is where she will use her maiden name, the rest is in her married name. Don't worry about USCIS being confused, they deal with it all the time.

Ok so she didn't take your name on the marriage certificate? SSA, banks, etc etc, will require a document showing legal name change, such as a marriage license/certificate that has her old name and her new name, before they change her name on anything. There is no way to do it other than changing her name individually with each institution, but she must have the marriage certificate to do so. She won't be able to change her name without such proof. Who told you that she could change her name individually without a marriage certificate with her new name on it? That doesn't sound right.

You misunderstood, there is nowhere to put married name on the marriage application form in Florida and the gentleman at the court house said we would have to change everything at each institution after we were married. You are correct she hasnt changed her name with SSA because they said she needs her green card or EAD before they can do it. Oh well were filing everything for AOS with the married name well see what happens i guess.

OK, that must be a Florida thing, the marriage certificates I have seen have a place for the "old" name and one for the "new" name, but I would think that regardless the marriage certificate is still a proof of legal name change, which she will use when she changes her name on her bank accounts, etc. I'm curious, did she sign the marriage certificate in her maiden or married name?

:) I guess I shouldn't have assumed all marriage certificates in different states are the same, OP sorry about creating confusion, as others have said she can use her married name if that is what she is going by.
