Hello,

My temporary Green Card expires on February 16th. I had planned on sending off form I-751 long ago, but my husband began to make less money right at the end of 2011, so this meant that we were not as financially well-off as I expected, and so the application fee was a bit out of our reach until now.

If I send off the application on February 11th will it be too late? This is when I anticipate having everything ready.

I'd appreciate any input.

ADJUSTMENT OF STATUS

AUGUST 10 2004 - Arrived in Austin, TX with F-1 student visa status.

EARLY JAN/FEB 2008 - Met Michael (my future husband) in the café where he works.

APRIL 12 2008 - We go on our first date. It lasted 2 days!

APRIL 13 2009 - Got married in Marfa, TX, in the middle of the West Texan desert.

NOVEMBER 4 2009 - Finally saved up enough money to send off I-130; I-485; I-131; I-765.

NOVEMBER 5 2009 - Package arrived at the Chicago Lockbox at 9:32 a.m! Signed for by A. Analakis. [DAY 1]

NOVEMBER 12 2009 - Cheques for I-485 and I-130 are finally cashed! [DAY 8]

NOVEMBER 12 2009 - I-485, I-130, I-1765 & I-131 are all "touched"! [DAY 8]

NOVEMBER 13 2009 - Received NOA's for I-485, I-130, I-765 & I-131 (Notice date - November 10th 2009).[DAY 9]

NOVEMBER 16 2009 - All forms were "touched" again. [DAY 12]

NOVEMBER 23 2009 - Received biometrics appointment letter (scheduled for December 14th 2009) [DAY 19]

NOVEMBER 24 2009 - Walk-in biometrics appointment in Austin ASC [DAY 20]

NOVEMBER 24 2009 - All forms were "touched" [DAY 20]

NOVEMBER 25 2009 - All forms were "touched" [DAY 21]

DECEMBER 28 2009 - Received AP approval letter, dated December 23. Received a text & email, too [DAY 54]

DECEMBER 29 2009 - Received email & text, saying EAD is approved; card production ordered. [DAY 55]

DECEMBER 31 2009 - Received AP document. [DAY 57]

JANUARY 2 2010 - Received EAD & interview letter (interview will be 02/16/10, San Antonio). [DAY 59]

FEBRUARY 16 2010 - Approved at interview! I-551 stamp in passport. [DAY 104]

Technically you can file it 90 days prior to the expiration date.

So if I was you I'd send it in this week.

Oh also, if you want, have a list of what documents you included so the experienced ppl here can take a quick look and give you some advises.

Last thing, use certified overnight, double safety when USCIS is known for getting applications lost in the chaos.

Thanks for your response!

So far I have the following documents in my application:

(1) Photocopies of both of our driving licences to prove that we lived at the same address in two separate locations since I received my temporary green card.

(2) A photocopy of my green card

(3) Photocopies of phone bills going back all the way back to February 2010, which show our "family plan".

(4) Photocopies of Christmas cards sent to both of us.

(5) Photocopies of the lease for the two new places we have lived since I became a temporary resident.

(6) Joint Medical Expenses. We opened a "Care Credit" account when I needed to get my wisdom teeth removed, and when our cat got sick.

(7) Photocopies of two joint tax return transcripts - 2009 and 2010

(8) Photocopies of our car insurance documents - both names on them.

(9) A photocopy of our life insurance policy.

(10) Photocopies of our joint back account statements going back to February 2010.

(11) Affidavits from friends.

(12) Photocopies of the two change of address forms I filled out online. Despite having done this, I received a letter from USCIS telling me that they were aware that I had changed address, and that I hadn't informed them?!

(13) Confirmation that my husband informed USCIS about our change of address.

There are a few other things I want to include but, honestly, the photocopying is taking me forever. Thank God I can do it at work, otherwise it would be costing me an arm and a leg! :-(

Oh, that's more than enough evidence. You should be good to go.

You don't really need to send copies of things month-by-month. Having a few bills from different periods of your relationship while in the U.S. is good enough.

From my point of view, you are good to go - sent all this as soon as possible. The most important is that USCIS get your ROC application before your temporary green card expire. They will send you RFE if they want anything else, and you will have time to prepare if that happens.

Thanks. The earliest I can send it off, money-wise, is definitely Saturday February 11th. I know that's cutting it a little neat, since my green card expires on the 16th, but I do plan on sending it certified overnight, so it should get there on time.

I wondered whether I had to send copies of every single bill since February 2010. I didn't think it was really necessary, but I'm a little OCD, so I couldn't resist photocopying everything. :-)

I know how that feels :blush:.

Luckily, my husband was there to stop me from copying every peace of paper, that shows both our names ("You don't want to cover them with our documents") :whistle:

So, at the end he chose like 1 bank statement from every 6 months in the last 2 years, and only 2 bills.

Well, you will be very close to your GC expiration date, but you should be fine as long as they got it before February 16th. Other option will be to borrow money for couple days (friends / family).
