I couldn't find the are we're this topic shoud fall unde. So I posted it here.

I am a green card holder and about to marry my fiancee who is a non US citizen that holds a tourist visa in a few months here in the US? Can someone tell me the process if when I sponsor him? What are the penalties? Will I get any penalties when my naturalization process take in effect?

I read different answers on different forums, but they are of no help. Please help, I would really appreciate it.

You go through the same I-130 process as a USC would, but will have a 2-3 year wait.

No penalty to you or him as long as he leaves the USA after the marriage and before his tourist visa runs out.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

There are guides above, exactly the same as for a USC except you will have a wait for a visa number to become available.

Procedurally, you would file an I-130 Petition for Alien Relative to obtain an eventual IR-1/CR-1 immigrant visa for your spouse after you marry.

Please note that your spouse will not be eligible to remain in the United States after your marriage. He will have to depart from the US prior to the expiration of his authorized period of stay under his tourist visa. Spouses of American citizens can file an I-485 application for adjustment of status concurrently with the I-130 because an immigrant visa will be immediately available upon approval of the I-130. But spouses of permanent residents must wait for a visa number to come available, at which time your spouse will be processed for an immigrant visa abroad.

Improved USCIS Form G-325A (Biographic Information)

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.

u need o read up on f2a sponsorship, which is what this forum is about, us permanent resident aka green card holders who are married to non-us citizens and sponsoring them.us citizenship is not required

An LPR can petition for a foreign spouse. Unlike the spouse of US citizen who have visa number immediately available to him/her, the spouse of an LPR must wait 2-3 years for a visa number to be made available. When a visa number is available, the foreign spouse can apply for an immigration visa. So, it is completely possible for an LPR to marry a non US citizen and live with that person in the USA - it just can't happen immediately. There are many LPRs who have successfully petition for their foreign spouses to come live in the US.

To petition for a spouse, the petitioner can be either a US citizen or LPR. To fulfill the Affidavit of Support, the joint sponsor or household member can be either a US citizen or LPR. So, US citizenship is not required to "help with the process of sponsorship."

A green card holder does not have to wait 10 years to gain US citizenship. A green card holder can apply to be a US citizen after 5 years. In addition, the spouse of a US citizen can apply for US citizenship after having a green card for 3 years.

Stop misinforming people - you can file for your spouse not being US citizen and you can become one either after 3 (based on marriage) or 5 years of LPR status - not 10.

The wait time for spouse of a green card holder is 5-6 years,just check the timeline in the USCIS web site it's very clear there about the time.Some aliens from China and Philippines it will take more than that.If you are ready to apply for Citizenship then do that it will be a lot easier to solve your problem.
