Hi all, thanks for your support and well wishes so far.

Received 2 RFE forms yesterday.

1. Tax return for 2011 - we were expecting this and are picking up from wife's accountant next week

2. Second form says based on documents submitted for the petitioner/sponsor the income did not meet 125% of poverty guidelines etc

For this we submitted just the last 6 months of bank statements that easily added up to more than the $23k required (125% 3 person household) so we are a little puzzled why 6 months of bank statements showing income over the level can be classed as "does not meet the 125%"

Any insight would be appreciated!

Thanks.

Is it clear from the bank statements that the money on your accounts comes from a continuous source of monthly income, that exceeds the annual minimum limit? Even if you bank account balance is over the minimum, that alone wouldn't be enough to meet the income requirement. Did you provide pay stubs, a job contract, a letter from employer or anything else that proves that your wife has continuous steady income that exceeds the annual minimum requirement?

No - fair comment! My wife is self employed. We have over 3 years of bank statements showing income over and above the poverty levels so I guess we just need to show the 'whole picture' rather than a snapshot.

Self-employed person needs newest tax return to prove the guideline. Bank statement is not income, it is asset which is not the right proof. I am pretty sure the 2010 tax return is below the guideline.
