B2 Denial HELP ME!?

Alright so if we do decide to go the K visa option, my next question would be, once my fiancée the USC files the petition to bring me out there, due to the fact I can't go and visit her because I'm not eligible for the vwp can she fly out to Australia for a few months while the application is processed or does she need to remain working?

She can do whatever she wants; do look over the requirements for financial support for Australia, and figure out what path will work for you. Is she quitting her job or just going on leave? Also look over the requirements for the waiver you'll most likely need. Having her show she can live for months in Aus might backfire for that.

She would probably take leave. If she did come out for a few months whilst the application was processing I would have to pay her credit card and her car repayments, probably also help her with rent too. I can definitely see what you are trying to say with it backfiring when applying for a waiver, but if we could show evidence that I was paying her bills etc that would help? If we have to provide an extreme hardship waiver for criminal conviction I think our main argument would be that she has far more family in USA than I do In Australia, she owes about $20,000 for secured car loan, she has already started a college degree a few years ago and would need to stay in the country to finish it one day, we will also be suggesting that being away from me and immigration headaches is making her depressed as well as me. Which it really really really is. Does anyone have any experience or stories of waivers? Would that be enough to obtain one?

If they deny the application based on my 1 conviction...
