Hi guys, I really need your help with financial paperwork.

Ok,

we need to have a co-sponsor,

1. What exactly forms does he need to fill? Does he need to attach his bank account info? How much should be his income - 125%?

2. Where I can find the list of forms my fiancee need to fill?

3. Does my fiance need to have notarized letter from employer?

4. Does my fiance need to file taxes for the last few years?

the next trouble is that my fiance has debts to courts and jails in a few states,

1. Will it affect on the process?

2. Does he need to pay off that debts before filling financial paperwork and before my interview?

I would very much appreciate your advice.

1. You need to find out how many dependents the joint supporter has.

To Find out how much your joint sponsor needs to make you can look at form I-864P

For instance, it has to be someone that lives with the petitioner. I will use me for example:

I live with my mother so it will be My mother, Me, plus the amount of people being petitioned.

I am only having my fiancee coming so it will be 3 dependents total.

So my joint sponsor would have to make 20, 750 or more gross per year.

2. Forms to be filled out:

I-864 for sponsor and joint sponsor.

I-864A, Contract Between Sponsor and Household Member

For both the Sponsor and Joint Sponsor:

1. Bank Statements for current month. Showing deposits.

2. Tax Statements meaning IRS Form 1040 Current year.. Since its 2/5/2012 then Form 1040 for year 2010; if after April 17 then 2011.

3. Since both my mom and I have VA Disability then Award Letters; My mom has military retirement so Tax Form 1099-R.

4. Statement from job with actual letter head from the company stating how much you make, when you started, how long, and average monthly yearly payment

Does not need to be notarized, just signed by your employer .

5. Also, W-2s will help as well.

About his court cases, that is per base... if you think it will permit a problem then you may have to hire an immigration lawyer.

You have to find out about the court cases.

No No, I mean they actually have to have residence with you or has claimed you on their taxes as a dependent.

so, any other tax-independent person (I mean like his friend from another city, who has never included my fiance's name when filing taxes) couldn't be a sponsor, am I right?

That is correct... The I-864A is a Contract between Household member and sponsor.

Just read the I-864A instructions I provided in the previous link and it will help answer questions.

You rarely find a best friend living in another city to claim his best friend on his taxes living in another city.

1. Dependents are usually for people who live with you that you support partial or full financial support. (Parents usually)

2. Usually your children if 18 and below, if your still living with your parents and going to school then 24, I think.

3. That you live with someone in the house and that person supports you and they will be consider "Head of Household" on the taxes with you as the dependent.

For instance,

I am 28 years old and going to school. I usually do my taxes as single and then my joint sponsor (mother) will do hers as single too.

If she wanted me and I would have to allow her, that she can file me as a dependent but when I do my taxes, i have to put in my taxes that someone claimed me on their taxes and I would have to give the information whom.

The difference between the two is that my taxes will be lowered since I was filed as a dependent on someone else's taxes and the Head of Household will get more money claiming me as a dependent.

Regardless, two tax forms have to be submitted. The only time you don't have to submit one is when you are under 18 and not working, if you are 15 or more working then you can file single as well or have your parents claim you, but your parents will get more money from you.. especially if your working. Sometimes they benefits and sometimes they pay, depends on the laws.

Also, you don't have to submit a tax return if you make less than a certain amount based on federal rules.

I honestly didn't have to file taxes this year because I made less than 5800 this year, but because my VA disability is non taxable then I didn't have to file either Federal or State, but because I went to school and I wanted to apply for the American Tax Credit, then i filed for my money that i benefited from the 1098-T.

Anna, any US citizen or LPR can be a joint sponsor. They need to fill out I-864 form and provide proof of income (tax returns past 3 years, letter from employer, pay stubs, copy of green card or US passport). Petitioner even when not making enough money still has to provide I-864 and supporting documents.

For a K1? Since when does a K1 sponsor file form I864?

Here is a link to the Kiev embassy page. You can find the requirements there. It might help. You can also email questions to the embassy at Kyiviv@state.gov It might take them a few days to respond but they have been helpful to me. Kiev doesn't require a I-864 for the visa applicant.

This is not accurate.

A co-sponsor can be ANY USC or LPR. They do not have to be family or live in the same house. Also, you are giving out instructions for the I-864A. That form can be used later when filing for AOS, if you in fact want a relative that resides with you to combine their income with yours to meet the 125% requirement when filing the I-864. Even when using the I-864, a co-sponsor is not required to be related or live with you. A co-sponsor can simply fill out their own separate I-864 instead of the I-864A. However, this did not pertain to the OP's question. For a K-1 visa, the I-134 is used.

The co-sponsor will need to make enough to cover themselves, spouse, children, any other dependents they have plus you, the intending immigrant. They both need to provide the most recent tax transcript, a letter from their employer stating position and salary plus a few months worth of their most recent pay stubs. The co-sponsor also needs to provide proof of being a USC or LPR.

If your fiance was required to file taxes and did not, then yes, he needs to file for those past years. They do not check your debts or credit scores though. The I-134 is approved or denied based on gross income and/or assets(if being used to meet the 125% poverty level).

Wow!!! A lot of bad info here at the begining of the thread. Anybody can be a co-sponsor and they would need to fill up the I-134 , not the other since its a K-1 visa.

She asked also if the fact that her fiance owes money. Probably not.

She asked if he needs to file his taxes for the past few years. Probably not, if he has a co-sponsor who qualifies to be a co-sponsor. BUT they might ask all these questions at the interview and its not going to look good if he didn't file his taxes the past few years. It's illegal not to file if you owe money. A lot of people dont know that. But the IRS can actually file criminal charges on you and you can do jail time for not filing your income tax if you owe money. Ask actor Wesley Snipes or Willy Nelson if you dont believe me. LOL
