My wife and I married recently two weeks ago on NYC city hall and I currently on the process of doing AOS and I have found some problems in terms of documenting address.

ADDRESS - I've been in the states for 14 years and have lived in two properties which are 5 blocks within each other, one where I lived since 1998-2008; I will call them "OLD" and "NEW" for convenience purpose. After doing some research, I realized now that as non-US citizen, I am required to file AR-11 (change of address) within 10 days of address change. I did not have knowledge of this till now and unfortunately all my USCIS records are in the OLD domicile. Wife just moved in to NEW domicile and has all her records (driver license, SS card) in her parents address. Also, just for information the only thing we have joint so far is a bank account and our marriage certificate under the NEW address which we planned to use for bona fide documentation.

Question - Should I do the AR-11 (change of address from OLD to NEW) and wait till it is updated and then file for AOS? Also, should my wife and I change our driver license/SS cards to the NEW domicile and then do the AOS as well?

Another question, for the I-130 form, my Wife (Petitioner) is currently USC but was born in China. According to her, she does not have a birth certificate and the only documents thus far are her passport and Naturalization documents. In terms of the form requirement for "proof of residency" I am confused if they mean proof of ones' address such as driver license or just documentation of citizenship is required, which would be all pages of her passport and Naturalization papers.

I look forward to your answers.

Regards,

Nimbuz

I just want to get the story straight.

1. Have you filed AOS package yet?

2. You moved from OLD place to NEW one in 2008?

3. Since 2008, you have not updated your address in any forms, is this correct?

4. Does the NEW place under your name? How do you manage to pay rent and utilities?

My husband was born in South Korea and he's now USC. I sent copy of his naturalization certificate and copy of his US passport. I didn't include copy of his Driver's license.

1) Not yet.

2) Yes.

3) You are correct, although I've updated my address through the college website but not through USCIS.

4) Yes. My parents pay for the bills. However, all rent and bills are under my name.

Umm... I never updated my address through the USCIS.

I belive the 'form of address change' is for the people who already filed some kind of document to USCIS and they moved while the case is pending. So they update their address so they can get any kind of confirmation letter from USCSI.(Does it make sense? Sorry, my English is not perfect.) If I'm wrong lease correct me.

And if the rent and bills are all under your name your current address is the NEW place. So I don't see any problem for you to use NEW address on AOS forms.
