My Honduran fiance is pregnant w/ another mans baby. We met right after he got her pregnant & ditched her to move to New York. He claims he wants the child in his name & is going to Honduras when she is born to make sure. He says he will not allow his daughter to come to the U.S. even though that is where he lives. We can't get his permision & he insists on bieng on the birth certificate with the child in his name. What are my options?

Wow sorry for your trouble - How far along is your K-1? Just thinking out loud now, Could you get it approved and her in the US so she can give birth here?

If not you need a good attorney to advise, perhaps full custody is needed so the mother and soon to be baby can travel into US without the bio father permission. If he is willing to be present at birth and name on birth certificate then it could be that he will be involved in the child's life? Support and visitations? Is that a good thing? Maybe. Is he a US citizen? How did he travel so easily to New York? Just thinking of a some useful strategy.

Contact a Hounduran attorney. This is a domestic issue. Houndruan laws will dictate whether he has any claim to the child.

As leverage, tell him that your fiancee will sue him for child support in the US. If he fails to pay child support, he can kiss the good moral character requirement good bye if he wants to become a US citizen. Don't pay your court ordered child support equals no naturalization.

Your options are fairly non-existent in terms of the baby. As the mother's fiance, or even as her husband, you don't have any claims to the baby nor do you have any say in her custody situation. I am not an expert in Honduran child protection and custody laws, but I would venture a guess that to permanently move abroad with a baby, both parents' permission is required.

However, in many countries there are laws to protect parents from menacing behavior from the other parent that may harm the well being of a child. Whether these laws exist in Honduras, I have no idea - but I would say that the only choice she has is to fight this in a Honduran family court and try to get sole custody, or his parental rights terminated. If it is clear that his behavior is solely driven by him wanting to cause harm to the mother, the courts may side with her.

You need to go to court in her country if the bio father doesn't change his mind. I cannot imagine a court making the child stay there when the father himself is in another country, ie making the child stay does not aid his/her relationship with the father.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Very important. It might not be a likely scenario for him to be able to return to Honduras before baby is born.

A lot of Honduran men leave wives/girlfriends/babies for US with intentions to return/send money. A lot of Honduran men are consequently unfaithful, so are a lot of Honduran women who get left waiting with babies. I've met a lot of sad folks on both sides of the border/love triangle.

My husband has one Honduran child with a Honduran woman, they were never married. She did not want his name on the birth certificate (he wanted to claim the child but I'm not sure what actions he took, he was very young). Instead she put her brother's name as father on birth certificate :blink:

Trying to understand the dynamic of your fiance's family is going to be quite a task.
