Best way to file for adult son

My wife came over on a K-1 Visa in 2010. We married and she received her conditional greencard in April 2011. We want to petition her oldest son who is now 21. Would it be better for me, as a USC, or my wife to petition for my step son?

hi, unfortunatly you cannot file for him now. he could have come as a K2 under his mother's K1 but he had to enter the country before his 21st birthday.

his mother will have to file for him, the wait for children over 21 unmarried is over 10 years if he is from the Philippines as well. while she is only a LPR. he cannot marry. you didn't mention what oountry he is from.

You can not petition for your step son. Only else the marriage took place before his 18th birthday.

If you are thinking of "reunification" with your stepson. You have another option. He could study there, if you like. Though I know it is very costly to study in the States but it is worth giving a shot. Just sharing, perhaps it is a good route or NOT.
