argument me and my husband in filing AOS

GOOD DAY to all VJ members..!! were preparing to gather all the docs required in filing AOS..hope you will have time to answer my questions.

i had my medical last April 2011 in St.LUKES..how many months does the medical result will expire?is this ok if i will just submit the result i have now from st.lukes last year? or I must go to a surgeon here in US and do another medical?

and my husband didnt file yet for the Federal tax now..is it ok if we will just pass his 2011 income tax?or we must submit the income tax this year?coz since he didnt file this time..

The most current tax return available. If that's 2010, then submit that.

The medical is usually valid for 12 months. When you file AOS within 12 months of the date you had it done you're good to go, only need the immunization record(a copy) to submit with the AOS. This is only if it's completed though.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

Depending on where you live/area you will be responsible for paying all doctor and laboratory fees for the medical examination. The fees vary depending on state and city. Your insurance will not pay for it either.

It varies state by state, doctor by doctor. Which state are you in? People in the same state as you may be able to offer suggestions of civil surgeons in your area. Best to call them all and compare prices.

Finally time for AOS.......

12/07/11 Sent AOS package

12/09/11 AOS package delivered

12/14/11 Received NOA for I-485 and I-765 (we're not applying for AP)

12/22/11 Received letter for Biometrics

01/04/12 Biometrics in Phoenix

01/31/12 Received email update from USCIS saying that we've been scheduled for an interview

02/03/12 Got an email saying card production had been ordered for my EAD...now just to wait for the card...

02/09/12 Received email saying EAD card has been sent

02/13/12 Received EAD card :D :D :D :D

03/06/12 Interview in Phoenix :).....Approved :D

03/14/12 Received Green card in mail.....

....no more USCIS until December 2013

That's in the Philippines, requirements are different when doing AOS. I-485 instructions applies here.

It is not about an expiration date. It is about the I-485 instructions. You do not need another medical exam for AOS if you had your medical within the last year before filing.

If all your vaccinations were complete at the time you had your medical, then just send a copy of the DS-3025 with your AOS paperwork. If you needed to get more vaccinations once you were here in the US, then you need to see a civil surgeon to get your vaccination records transcribed from the DS-3025 + whatever vaccinations you were missing onto an I-693 form. You do not need a whole new medical if your medical was done within the last year.

As far as I know medical exams for K1 are good for one year, so yours will expire March this year. When I filed my AOS, i didnt go to any civil surgeon here, i just made a photocopy of my vaccinations and that was it. With regards to income tax, your husband's latest (2010) income tax will be fine.

As far as I know medical exams for K1 are good for one year, so yours will expire March this year. With regards to income tax, your husband's latest (2010) income tax will be fine.

thank u for the info..coz i was thinking not to go to the surgeon anymore due to it will cost another money again.we are having hard time to save money for the AOS due to my husband income is low in the last couple of months...

and now that we are married is HiS 2011 Income tax is ok to submit...?coz his 2011 income tax his status was single and now we are married...!

If you two were married in 2011, then yes his tax status would be filed as married not single.

As long as you were married within the year 2011 regardless of date, your husband will be considered married when he file for his 2011 income tax.

Your husband, as a USC, always has to file taxes. Tax evasion is a felony crime. But filing taxes doesn't necessarily mean paying taxes. I suggest you talk to your husband. Because you got married last year, I bet you guys will get a big tax REFUND, which means money back.

I do taxes for a living. You either file as married filing jointly or married filing separate. But either way you must filed married. You will gain the best benefit by filing married filing jointly since you will be able to be claimed as an exemption for income taxes purposes.
